Under and by virtue of the authority
vested in me as Trustee in that certain Deed of Trust dated
June 12, 2009 executed by Sweetie B. Wooten unto William F. Schneller
as Trustee, to secure an indebtedness therein described to Bank of
Holly Springs, said Deed of Trust being of record as Instrument No.
2009002780 of the land records of the Clerk of the Chancery Court of
Marshall County, Mississippi;
Deed of Trust dated September 22, 2010
executed by Sweetie B. Wooten unto William F. Schneller as Trustee, to
secure an indebtedness therein described to Bank of Holly Springs, said
Deed of Trust being of record as Instrument No. 2010004182 of
the land records of the Clerk of the Chancery Court of Marshall County,
Mississippi; and default having been made in the
payment of the indebtedness thereby secured, and the undersigned having
been requested by the legal holder of said indebtedness to foreclose
said Deed of Trust, notice is hereby given that I, as Trustee
aforesaid, will, within lawful hours, at the South front door of the
Marshall County Courthouse, in the City of Holly Springs, Mississippi,
on Friday, March 22, 2013 offer for sale and sell at public outcry to
the highest bidder for cash, the following described property, situated
in the County of Marshall, State of Mississippi, to wit:
Lot No. 107 of the Meadows Subdivision Phase II-B on Section 36,
Township 3 South, Range 3 West and according to plat of said
subdivision recorded in Plat File No 536 A&B of the records of
the clerk of the Chancery Clerk of Marshall County, Mississippi, this
being the same property conveyed to Christopher Kimmons by virtue of
Warranty Deed dated the 22nd day of June 2004 found and recorded in
Land Deed Book 348 at page 324-325 with Assumption Agreement dated July
30, 2004 in the office of the Chancery Clerk of Marshall County,
Mississippi. Also being the same property conveyed to
Josephine Kimmons by virtue of Warranty Deed dated 24th day
of November, 1987 found and recorded in Land Deed Book 218 at page
108-109 with Assumption Agreement dated November 24, 1987 in the office
of the Chancery Clerk fo Marshall County, Mississippi.
