February 7, 2012 executed by Freddie L. Ware unto William F. Schneller
as Trustee, to secure an indebtedness therein described to Bank of
Holly Springs, said Deed of Trust being of record as Instrument No.
2012000713 of the land records of the Clerk of the Chancery Court of
Marshall County, Mississippi; and default having been made in
the payment of the indebtedness thereby secured, and the undersigned
having been requested by the legal holder of said indebtedness to
foreclose said Deed of Trust, notice is hereby given that I,

Northeast corner of the Northwest Quarter of the Southwest Quarter of

Mississippi; run thence North 88 degrees 35 minutes 48 seconds West
443.57 feet to a 1/2" rebar found; run thence North 00 degrees 01
minutes 48 seconds West 523.58 feet to a rebar found; said point being
the point of beginning; run thence North 89 degrees 09 minutes 37
seconds West 863.70 feet to a 1/2" rebar found on the east side of
Watson-Desoto Public Road; run thence North 00 degrees 51 minutes 55
seconds West 251.75 feet along said road to 1/2" rebar set; run thence
South 89 degrees 09 minutes 37 seconds East leaving the east side of
Watson-Desoto Road for a distance of 867.37 feet to a 1/2" rebar set;
run thence South 00 degrees 01 minutes 48 seconds East for a distance
of 251.67 feet to the point of beginning. Said tract containing 5.00
acres more or less. According to plat of survey by Perry D.
Young P.L.S. No 2665 dated May 21, 2007.
Source Deed: This is a part of the same
land and property as conveyed to Flick’s Realty, Inc. By Warranty Deed
from Hazel C. Hewlett dated June 22, 2005 and recorded in Land Deed
Book 358 at page 144 in the office of the Chancery Clerk of Marshall
County, Mississippi.
Subject to Rights of Way and easements
for public road and utilities.
Subject to laws, ordinances and
regulations which govern the use and occupancy of this land enacted by
the United States of America, The State of Mississippi and its
political subdivisions and particularly including the subdivision

SUBSTITUTED TRUSTEE'S
NOTICE OF SALE
WHEREAS, on January 3, 2008, Christie
A. Humphrey and Rocky J. Humphrey, wife and husband executed a certain
deed of trust to William F. Schneller, Trustee for the benefit of
Mortgage Electronic Registration Systems, Inc., which deed of trust is
of record in the office of the Chancery Clerk of Marshall County, State
of Mississippi in Instrument No. 2008000076 and re-recorded in
Instrument No. 2008001507; and
WHEREAS, said Deed of Trust was
subsequently assigned to Cimarron Mortgage Company by instrument dated
August 18, 2009 and recorded in Instrument No. 2009004175 of the
aforesaid Chancery Clerk's office; and
WHEREAS, Cimarron Mortgage Company has
heretofore substituted J. Gary Massey as Trustee by instrument dated
September 3, 2009 and recorded in the aforesaid Chancery Clerk's Office
in Instrument No. 2009004360; and
WHEREAS, default having been made in
the terms and conditions of said deed of trust and the entire debt
secured thereby having been declared to be due and payable in
accordance with the terms of said deed of trust, Cimarron Mortgage
Company, the legal holder of said indebtedness, having requested the
undersigned Substituted Trustee to execute the trust and sell said land
and property in accordance with the terms of said deed of trust and for
the purpose of raising the sums due thereunder, together with
attorney's fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, J. Gary Massey,
Substituted Trustee in said deed of trust, will on February 7, 2013
offer for sale at public outcry and sell within legal hours (being
between the hours of 11:00 a.m. and 4:00 p.m.), at the South Door of
the County Courthouse of Marshall County, located at Holly Springs,
Mississippi, to the highest and best bidder for cash the following
described property situated in Marshall County, State of Mississippi,
to-wit:
5.00 acres of land located in the Northeast Quarter of Section 36,
Township 4 South, Range 4 West, Marshall County, Mississippi, described
as follows: Commence at an iron rod found at the Northeast Corner of
said Section 36; thence run North 88 degrees 27 minutes West 1,693.91
feet to an iron pipe found at a fence corner; thence South 00 degrees
35 minutes 00 seconds West 776.00 feet to a point on the East margin of
the county road; thence continue along the East margin of said road
South 32 degrees 32 minutes 00 seconds East 100.00 feet to the Point of
Beginning; thence continue along the East margin of said road the
following three (3) calls; (1) South 31 degrees 18 minutes 00 seconds
East 163.62 feet; (2) South 33 degrees 31 minutes 00 seconds East
124.33 feet; (3) South 37 degrees 18 minutes 00 seconds East 112.05
feet; thence leaving said road run South 88 degrees 31 minutes 00
seconds East, 538.64 feet passing an iron rod found at 50.0 feet on
line to an iron rod set; thence North 336.81 feet to an iron rod set;
thence North 89 degrees 16 minutes 00 seconds West 760.08 feet passing
an iron rod found at 710.08 feet on line to the Point of Beginning.
I WILL CONVEY only such title as vested in me as Substituted Trustee.

The City of Holly Springs Planning Commission will hold a public
hearing, February 15, 2013, at 11:30 a.m. at City Hall, 160 S. Memphis
St., Holly Springs, MS, 3rd floor, to consider text amendments to the
Business Court Square Zoning District in order to clarify its purpose
and to consider the uses permitted therein. All interested parties are
invited to attend. Additional information may be obtained from the
Holly Springs zoning Administrator whose office is located at the Holly
Springs City Hall, 160 S. Memphis St., Holly Springs, MS, 3rd floor,
