WHEREAS, on the 18th day of February,
2013, the Holder of said Deed of Trust substituted and appointed John C
Morris IV as Trustee in said Deed of Trust, by instrument recorded in
the office of the aforesaid Chancery Clerk in Instrument# 2013000811;
and
WHEREAS, default having been made in
the payments of the indebtedness secured by the said Deed of Trust, and
the holder of said Deed of Trust, having requested the undersigned so
to do, on the 11th day of April, 2013, I will during the lawful hours
of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale
and will sell, at the south door of the Marshall County Courthouse at
Holly Springs, Mississippi, for cash to the highest bidder, the

Supervisors will receive sealed bids in the office of the County
Administrator, Post Office Box 219, 111 South Market Street, Holly
Springs, Mississippi 38635, until Monday May 6, 2013 and
thereafter publicly open them for Scrub Seal application per
mile. Bid shall be with CRS-2P and Bid shall be with Marshall
County furnishing the rock.
Bid prices will be for a period of
twelve 12 months. All bidders shall be precisely clear as to
the specifications of their products.
The Board reserves the right to reject

Public Notice
The Marshall County Planning Commission
will meet for their regular scheduled meeting on Thursday, April 11,
2013 at 2:00 p.m. in the Marshall County Zoning Office at 590 Old
Highway 78-East, Holly Springs, Mississippi. The public is invited to
attend.
The following requests will be on the
agenda:
ITEM 1: Marshall County Water
Association requests to be allowed to construct a water tank on
Brookside Baptist Church property located at 4993 Highway 302. The tank
will be at the rear south/east corner of the 10 acres, approximately
2500 feet south of Highway 302 and 2500 feet east of Bailey Drive. The
property in question is part of Olive Branch East Subdivision and zoned
R-E
ITEM 2: Mrs. Marvia Ealey Kilgore
requests to be allowed to construct a recreational center and park area
for family oriented activities (school field trips, seminars, summer
camps, sports activities and social gatherings) on her property located
on Moore Road. The park area will include pavilions, picnic tables,
fishing pond and walking trails. The property in question is Lot #9 of
Ealey Subdivision, contains approximately 3.93 acres and zoned R-1.
ITEM3: Mr. and Mrs. James Gullett at
3225 Hernando Road are requesting to be allowed to deed 1.50 acres of
their 19 acres to their son, Matthew Gullett so he can place a double
wide mobile home. The property in question is Lot #4 of Cherokee
Subdivision and zoned R-1.
ITEM4: Mr. Mitchell Norman requests to
be allowed to construct a barber shop on his property located at the
corner of Rabbit Ridge Road and Highway 178 West. The property in
question contains approximately 2.61 acres and is zoned

ITEM5: Mr. Jeremy Ryan requests to be
allowed to deed two (2) acres from his 5.30 acres located on East
Gramling Road to place a mobile home. The property in question is Lot

WHEREAS, on February 15, 2006, Gregory
O. Malone and Evelyn L. Harris executed a certain deed of trust to Mark
T. Davis, Trustee for the benefit of Mortgage Electronic Registration
Systems, Inc. nominee for First National Banker's Bank, its successors
and assigns which deed of trust is of record in the office of the
Chancery Clerk of Marshall County, State of Mississippi in Book 403 at
Page 421; and
WHEREAS, said Deed of Trust was
subsequently assigned to JPMorgan Chase Bank, National Association by
instrument dated March 3, 2012 and recorded in Instrument No.
2012001186 of the aforesaid Chancery Clerk's office; and
WHEREAS, JPMorgan Chase Bank, National
Association has heretofore substituted J. Gary Massey as Trustee by
instrument dated February 25, 2013 and recorded in the aforesaid
