The Marshall County Planning Commission
will hold a public meeting on Thursday, March 8, 2012, at the Marshall
County Zoning and Planning Office at 590 Highway 178 East, Holly
Springs, Mississippi.
The Commission will hear a rezoning
request from WCA Land. The property is located on North Lenderman,
consists of Parcel 184-23-5 (39.5 acres) and Parcel 184-14-3 (19 acres)
for a total of 58.5 acres.
A survey copy of the rezoning can be
viewed at the Marshall County Zoning and Planning Office.
The Commission will make a
recommendation to the Marshall County Board of Supervisors in regard to
rezoning (the actual decision to rezone is a decision that is made by
the Board of Supervisors).
The public is cordially invited. Any
person may appear before the Commission either in person or by agent or
may file a written comment regarding the request with the
Administrative Official prior to the hearing.

RESOLUTION OF THE MAYOR AND BOARD OF ALDERMEN
OF THE TOWN OF BYHALIA, MISSISSIPPI
WHEREAS, at the request of
the Mayor and Board of Aldermen of the Town of Byhalia, a local and
private bill was passed by the Mississippi legislature at their 2010
Regular Session; and
WHEREAS, the bill was designated as
House Bill 1597 and titled as follows:
AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE TOWN OF BYHALIA,
MISSISSIPPI, TO LEVY A TAX UPON THE GROSS SALES OF HOTELS AND MOTELS
DERIVED FROM ROOM RENTALS; TO PROVIDE THAT THE REVENUE FROM THE TAX
SHALL BE EXPENDED BY THE TOWN OF BYHALIA TO ENHANCE TOURISM AND PARKS
AND RECREATION; TO PROVIDE THAT THE TAX SHALL BE COLLECTED BY THE STATE
TAX COMMISSION AND PAID TO THE TOWN OF BYHALIA; TO PROVIDE FOR AN
ELECTION ON WHETHER THE TAX MAY BE LEVIED; AND FOR RELATED PURPOSES; and
WHEREAS, the bill provides that governing authorities of the Town of
Byhalia shall adopt a resolution declaring their intention to levy the
tax, setting forth the amount of the tax to be imposed, the date upon
which the tax shall become effective and calling for an election to be
held on the question. The bill further provides that the date
of the election shall be fixed in the resolution and notice of such
intention and the election shall be published once each week for at
least three (3) consecutive weeks in a newspaper published or having a
general circulation in the Town of Byhalia, with the first publication
of the notice to be made not less than twenty-one (21) days before the
date fixed in the resolution for the election and the last publication
to be made not more than seven (7) days before the election.
NOW THEREFORE, be it resolved by the
Mayor and Board of Aldermen of the Town of Byhalia, Mississippi, as
follows, to-wit:
1. The purpose of this
resolution is to declare the intention of the Town of Byhalia to levy
the tax as provided for in the legislature, House Bill 1597 and the
amount of the tax shall be 2% of the gross proceeds of room rentals for
each such hotel or motel.
2. The tax shall become
effective on the 1st day of April, 2012.
3. The election as described herein
shall be held on the 13th day of March, 2012, at voting precinct
located at the Byhalia Fire Department at 24 Hwy 309 N.
4. All qualified electors of
the Town of Byhalia may vote and the ballots used in the election shall
have printed thereon a brief statement of the amount and purposes of
the proposed tax levy and the words “FOR THE TAX”, and on a separate
line “AGAINST THE TAX”, and the voters shall vote by placing a cross
(X) or check (∫ )opposite their choice on the proposition.
5. The results of the
election shall be canvassed and certified and the town may levy the tax
if sixty percent (60%) of the qualified electors who vote in the
election vote in favor of the tax.
6. At least thirty (30) days
before the effective date of the tax provided in this section, the
governing authorities shall furnish to the State Tax Commission a
certified copy of the resolution evidencing the tax.

which time and date written objections to the validation of the
issuance of said obligation, if any, must be filed.
