stated above) separate but related procedural requirements for
activities to be undertaken by the Mississippi Development Authority.
REQUEST for RELEASE of FUNDS
On or about February 13,2012 at least
one day after the end of the comment period the Mississippi Development
Authority / Community Service Division (MDA/CSD) will submit a request
to the Department of Housing and Urban Development (HUD) for the
release of HOME funds under Title II of the Cranston-Gonzalez National
Affordable Housing Act of 1990, as amended, to undertake a project: by
Rust College Community Development Corporation, Holly Springs, Marshall
County, Mississippi for the purpose of constructing three (3)
Single-Family homes and Homebuyers Assistance. The target site consists
of three (3) 70 feet x 197 feet lots of lands. Estimated
funding for the project is $325,000.00 and project location (394, 407
and 409 N. Walthall Street) in Holly Springs, Mississippi.
FINDING of NO SIGNIFICANT IMPACT
The Mississippi Development Authority /
Community Service Division (MDA/CSD) has determined that the project
will have no significant impact on the human environment. Therefore, an
Environmental Impact Statement under the National Environmental Policy
Act of 1969 (NEPA) is not required. Additional project information is
contained in the Environmental Review Record (ERR) on file at
Mississippi Development Authority/Community Service Division 501 West
street, Jackson, Mississippi 39205 office where ERR can be examined or
copied weekdays 8:00 A.M. to 5:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency
disagreeing with this determination or wishing to comment on the
project may submit written comments to the Mississippi Development
Authority Attn: Compliance Bureau at P.O. Box 849, Jackson, Mississippi
39205-0849. All comments received by February 10, 2012 will be
considered by the MDA/CSD prior to authorizing submission of a request
for release of funds. Comments should specify which Notice they are
addressing.
RELEASE of FUNDS
The MDA certifies to HUD that
Mississippi Development Authority/Community Service Division consents
to accept the jurisdiction of the Federal Courts if an action is
brought to enforce responsibilities in relation to the environmental
review process and that these responsibilities have been satisfied.
HUD's approval of the certification satisfies its responsibilities
under NEPA and related laws and authorities, and allows the Mississippi
Development Authority to use HUD Program funds.
OBJECTIONS to RELEASE of FUNDS
HUD will accept objections to its
release of funds and the MDA’s certification for a period of fifteen
days following the anticipated submission date or its actual receipt of
the request (whichever is later) only if they are on one of the
following bases: (a) the certification was not executed by the
Certifying Officer of the Mississippi Development Authority; (b) the
Mississippi Development Authority has omitted a step or failed to make
a decision or finding required by HUD regulations at 24 CFR Part 58;
(c) the grant recipient has committed funds or incurred costs not
authorized by 24 CFR Part 58 before approval of a release of funds by
Department of Housing and Urban Development; or (d) another Federal
agency acting pursuant to 40 CFR Part 1504 has submitted a written
finding that the project is unsatisfactory from the standpoint of
environmental quality. Objections must be prepared and submitted in
accordance with the required procedures (24 CFR Part 58) and shall be
addressed to Department of Housing and Urban Development, Attn: Lynn
Tynes, CPD Director at 100 West Capitol Street, Jackson, Mississippi
39269. Potential objectors should contact HUD to verify the actual last
day of the objection period.

will meet for their regular scheduled meeting on Thursday, February 9,
