WHEREAS, on the 2nd day of March, 2007 and acknowledged on the 2nd day of March, 2007, J. Brandon Johnson aka Jeffrey Brandon Johnson, an unmarried person, executed and delivered a certain Deed of Trust unto Jeanine B. Saylor, Trustee for 1st Trust Bank for Savings, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Marshall County, Mississippi in Book 433 at Page 843; and
WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to Bank of America, N.A., successor by merger to BAC Home Loans Servicing, LP fka Countrywide Home Loans Servicing LP by instrument recorded in the office of the aforesaid Chancery Clerk in Instrument #2012001117; and
WHEREAS, on the 9th day of July, 2012, the Holder of said Deed of Trust substituted and appointed John C Morris IV as Trustee in said Deed of Trust, by instrument recorded in the office of the aforesaid Chancery Clerk in Instrument #2012002967; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 23rd day of August, 2012, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the south door of the Marshall County Courthouse at Holly Springs, Mississippi, for cash to the highest bidder, the following described land and property situated in Marshall County, Mississippi, to-wit:
Commence at the Southwest corner of Lot No. 18 of Victoria Meadow Farms in Section 10, Township 3 South, Range 4 West, as appearing of record in Plat Book 9, Page 50 (Plat File No. 409B) in the Chancery Clerk's office of Marshall County, Mississippi; thence North 0 degrees 5 minutes W 320.8 feet to the point of beginning in the north right of way line of Interstate Highway 78; thence continue North 0 degrees 05 minutes West 287.2 feet to the center of public road; thence northeastwardly along a curve to the left 137.0 feet (Chord=north 61 degrees 27 minutes 13 seconds East 133.09 feet) to a point; thence South 41 degrees 15 minutes 22 seconds East 712.6 feet to the point of intersection with the north right of way of Interstate Highway 78; thence North 72 degrees 14 minutes 11 seconds West along said north right of way line 522.17 feet to a point; thence North 74 degrees 19 minutes West along said north right of way line 93.3 feet to the point of beginning and containing 2.95 acres, more or less.
I will only convey such title as is vested in me as Substitute Trustee.
