WHEREAS, on July 27, 2006, David
Yates
and wife, Jamie Yates, executed a deed of trust to Southern Trust Title
Company, Trustee for the benefit of Mortgage Electronic Registration
Systems, Inc., which deed of trust is recorded in Deed of Trust Book
415 at Page 744, corrected and re-recorded in Book 417 at Page 106 and
reformed by Final Judgment in Cause No. 2011-0056R, recorded as
Instrument No. 2012002478 in the Office of the Chancery Clerk of the
County of Marshall, State of Mississippi;
and
WHEREAS, the aforesaid deed of trust
was assigned to U.S. Bank National Association, as Trustee for FFMLT
2006-FF14, Mortgage Pass-Through Certificates, Series 2006-FF14 by
instrument dated May 8, 2007, and recorded in the Office of the
aforesaid Chancery Clerk in Book 94 at Page 648; and
WHEREAS, the aforesaid, U.S. Bank
National Association, as Trustee for FFMLT 2006-FF14, Mortgage
Pass-Through Certificates, Series 2006-FF14, the holder of said deed of
trust and the note secured thereby, substituted John C. Underwood, Jr.,
as Trustee therein, as authorized by the terms thereof, by instrument
dated June 13, 2007 and recorded in the Office of the aforesaid
Chancery Clerk in Book 441 at Page 455; and
WHEREAS, default having been made in
the terms and conditions of said deed of trust and the entire debt
secured thereby, having been declared to be due and payable in
accordance with the terms of said deed of trust, and the legal holder
of said indebtedness, U.S. Bank National Association, as Trustee for
FFMLT 2006-FF14, Mortgage Pass-Through Certificates, Series 2006-FF14,

PROVIDE ENGINEERING SERVICES
This is a Request for Proposals to
provide Engineering Services for Marshall County’s Community
Development Block Grant project for Public Infrastructure Improvements
for Economic Development.
You are invited to submit a proposal in
accordance with this request to, Board of Supervisors, Marshall County,
P O Box 219, Holly Springs, MS 38635, not later than 4:00 p.m. on
August 7, 2012. Proposals shall be marked on the outside as “Proposal
for Engineering Services/FY 2012-CDBG. Information concerning
the proposals may be obtained by calling Wanda Christian at (662)
728-6248 ext 113.
The contract will be awarded to the
responsible offeror whose proposal is within
the competitive range and determined to
be the most advantageous to Marshall County, price, and other factors
considered. The factors to be considered in evaluation of proposals and
their relative importance are set forth (below in instruction to
Bidder).
The Engineer shall perform all the
necessary engineering services to properly carry-out the activities in
the project, in accordance with State and HUD prescribed rules,
regulations, policies, and State law. The project includes the
following activities.
Public Infrastructure Improvements for
Economic Development.
Prepare plans and specifications for
project.
Construct and distribute bid packets
(insuring that all Federal and State requirements are met in contract
preparation).
Assist in bid opening and prepare bid
tabulation
Conduct pre-construction conference
with contractor, and staff representatives, documenting files with
minutes of meeting.
Conduct work in-progress inspections
giving periodic reports to the County and approving any and all partial
payment requests.
The contract will be on a fixed price
basis. Those desiring consideration should submit proposals by the time
and date above stated and must include the following:
Qualifications- List of qualifications
of each staff person assigned to project. (40 points)
2) Experience-
Information regarding the experience of the firm. This
information
should include types of project activities undertaken. (40 points)
3) Capacity for
Performance-Identify the number and title of staff available to be
assigned to provide services. (20 points)
All proposals will be rated on the
above system to determine the best offeror.
Proposals will be reviewed by the Board
of Supervisors using the above selection criteria The Board will assign
points to each criteria based on the content of the proposal.
Negotiations will be conducted to determine a mutually satisfactory
contract with the firm receiving the highest accumulated points, as
rated by the Board. If a mutually satisfactory contract cannot be
negotiated with the firm, the firm will be requested to submit a best
and final offer in writing; and if a contract cannot be reached after
the best and final offer, negotiations will be initiated with the
subsequently listed firm in order of rating. This procedure
will be continued until a mutually satisfactory contract has been
negotiated. In addition to reaching a fair and reasonable
price for the required work, the objective of negotiations will be to
reach an agreement on the provisions of the proposed contract including
scope and extent of work, and other essential requirements.
The County reserves the right to reject
any and all proposals.
