The Marshall County Planning Commission
will meet for their regular scheduled meeting on Thursday, August 9,
2012, at 2:00 p.m. in the Marshall County Zoning Office at 590 Old
Highway 78-East, Holly Springs, Mississippi. The public is invited to
attend.
The following requests will be on the
agenda:
ITEM 1: Mr. Yancy Drew Cothern is
requesting to be allowed to construct 30-60 storage units on one acre
of his property located at 6170 Highway 311. The property in question
contains 19.118 acres and is zoned R-E.
ITEM 2: Mr. and Mrs. James R. Evans at
300 Leewood Road are requesting to be allowed to construct a cabin
(approximately 1000 sq. ft.) on their property (Lot #41 of Leewood
Subdivision) to be used as a guest house (will not be used for a
permanent residence or rental). The property in question contains nine
(9) acres and is zoned R-2.
ITEM 3: Mr. and Mrs. James A. Williams
are requesting to be allowed to place a second residence (house or
double wide mobile home) on property located at 1636 Wildcat Bottom
Road. The property in question is Lot #2 of Sportsman Paradise
Subdivision, contains 16.40 acres and is zoned R-2. Tabled from the

WHEREAS, the City of Holly Springs,
Mississippi, has in place a Comprehensive Plan Zoning Ordinance (the
“Zoning Ordinance”), governing the use of property located within the
City of Holly Springs and providing rules, regulations and penalties
for violations of said ordinance.
WHEREAS, the zoning ordinance
anticipated and provided for amendments to the ordinance by allowing
the municipality to give notice and provide a public hearing to
consider such amendments.
WHEREAS, the Mayor and Board of
Aldermen of the City of Holly Springs have determined that the adoption
of additional rules and regulations are necessary to protect the
citizens of Holly Springs, Mississippi.
WHEREAS, the City of Holly Springs
hereby give notice that they will hold a public hearing to consider
certain amendments to the zoning ordinance on TUESDAY, the 7TH day of
AUGUST, 2012 at 5:30 P.M. in the Board Room at City Hall, located at
160 South Memphis Street, Holly Springs, Mississippi.
WHEREAS, the Mayor and Board of
Aldermen of the City of Holly Springs will consider adoption of the
following ordinance as amendments of the zoning ordinance of the City
of Holly Springs:
ORDINANCE AMENDING THE COMPREHENSIVE
ZONING REGULATIONS FOR THE CITY OF HOLLY SPRINGS, MISSISSIPPI, BY
DELETING SECTION 10.8 OF SAID ORDINANCE AND CREATING A DOWNTOWN COURT
SQUARE COMMERCIAL BUSINESS DISTRICT IN THE HISTORIC DOWNTOWN AREA
BE IT ORDAINED BY THE MAYOR AND BOARD
OF ALDERMEN OF THE CITY OF HOLLY SPRINGS, MISSISSIPPI, AS FOLLOWS:
WHEREAS, the City of Holly Springs,
Mississippi, has in place a Comprehensive Plan Zoning Ordinance (the
“Zoning Ordinance”), governing the use of property located within the
City of Holly Springs and providing rules, regulations and penalties
for violations of said ordinance.
WHEREAS, the zoning ordinance
anticipated and provided for amendments to the ordinance by allowing
the municipality to give notice and provide a public hearing to
consider such amendments.
WHEREAS, the Mayor and Board of
Aldermen of the City of Holly Springs have determined that the adoption
of additional rules and regulations are necessary to protect the
citizens of Holly Springs, Mississippi.
WHEREAS, the City of Holly Springs did
give notice of a public hearing to consider certain amendments to the
zoning ordinance on TUESDAY, the 7TH day of AUGUST, 2012 at 5:30 P.M.
at the Board Room at City Hall, located at 160 South Memphis Street,
Holly Springs, Mississippi.
WHEREAS, the Mayor and Board of
Aldermen of the City of Holly Springs did consider the amendments to
the Comprehensive Zoning Ordinance of the City of Holly Springs and
herby amend said Comprehensive Zoning Ordinance as follows:
AMENDMENT NO. 1:
SECTION 10.8 of said Comprehensive
Zoning Ordinance is hereby deleted in its entirety.
AMENDMENT NO. 2:
1.) A new district is hereby created
within the municipal limits known as “The Downtown Court Square
Commercial Business District.”
2.) The boundaries of said
district shall be defined by the City Streets of Memphis Street,
College Avenue, Market Street and Van Dorn Avenue as those streets
front the Historic Court Square, and one block beyond, in each
direction.
3.) This district is created
for the purpose of joining with Main Street Association in development
of commercial traffic through development of retail, personal and
professional facilities in order to create a tax
base. The district excludes any non-profit or
non-tax revenue producing entities.
The foregoing Ordinance was introduced
in writing and was then read and considered, first section by section,
and then as a whole, and upon the motion of Alderman __________,
seconded by Alderman ____________, the question was duly put and the

certain deed of trust to First American Title, Trustee for the benefit

Cendant Mortgage Corporation, which deed of trust is of record in the
office of the Chancery Clerk of Marshall County, State of Mississippi
in Book 300 at Page 156 and Modified as Instrument No.

WHEREAS, said Deed of Trust was
subsequently assigned to PHH Mortgage Corporation by instrument dated
February 2, 2010 and recorded in Instrument No. 2010000622 of the
aforesaid Chancery Clerk's office; and
WHEREAS, PHH Mortgage Corporation has
heretofore substituted J. Gary Massey as Trustee by instrument dated
