NOTICE OF SALE
WHEREAS, on January 12, 2005, Sheila S.
Peyton, an unmarried person executed a certain deed of trust to Emmett
James House or Bill R. McLaughlin, Trustee for the benefit of Union
Planters Bank, N. A. which deed of trust is of record in the office of
the Chancery Clerk of Marshall County, State of Mississippi in Book 374
at Page 244 and re-recorded in Instrument No. 2011003336; and
WHEREAS, said Deed of Trust was
subsequently assigned to EverBank by instrument dated August 11, 2008
and recorded in Instrument No. 2008004866 and re-recorded in Instrument
# 2011003556 of the aforesaid Chancery Clerk's office; and
WHEREAS, EverBank has heretofore
substituted J. Gary Massey as Trustee by instrument dated September 13,
2011 and recorded in the aforesaid Chancery Clerk's Office in
Instrument # 2011003720; and
WHEREAS, default having been made in
the terms and conditions of said deed of trust and the entire debt
secured thereby having been declared to be due and payable in
accordance with the terms of said deed of trust, EverBank, the legal
holder of said indebtedness, having requested the undersigned
Substituted Trustee to execute the trust and sell said land and
property in accordance with the terms of said deed of trust and for the
purpose of raising the sums due thereunder, together with attorney's
fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, J. Gary Massey,
Substituted Trustee in said deed of trust, will on November 3, 2011
offer for sale at public outcry and sell within legal hours (being
between the hours of 11:00 a.m. and 4:00 p.m.), at the South Door of
the County Courthouse of Marshall County, located at Holly Springs,
Mississippi, to the highest and best bidder for cash the following
described property situated in Marshall County, State of Mississippi,
to-wit:

WHEREAS, on August 12, 2002, Donnie W.
Key (D.W. Key) and wife, Noreena M. Key, executed a deed of trust to J.
Patrick Caldwell, trustee for the benefit of BancorpSouth Bank, which
deed of trust is recorded in Deed of Trust Book 309 at Page 208 in the
office of the Chancery Clerk of the County of Marshall, State of
Mississippi; and
WHEREAS, the aforesaid, BancorpSouth
Bank, the holder of said deed of trust and the note secured thereby,
substituted John C. Underwood, Jr., as Trustee therein, as authorized
by the terms thereof, by instrument dated September 2, 2011 and

WHEREAS, default having been made in

WHEREAS, on July 22, 1999, Fred J.
Hemmer executed a promissory note payable to the order of Brighton
Bank; and
WHEREAS, the aforesaid promissory note
was secured by a Deed of Trust dated July 22, 1999, executed by Fred J.
