AN ORDINANCE REGULATING DANCE HALLS, BARS, BAR AND GRILLS, NGHTLUBS AND
LIQUOR LICENSEE’ CLOSING HOURS; AND DECLARING AN EMERGENCY
BE IT ORDAINED by the Mayor and Board of Alderman of the City
of Holly Springs, Mississippi that:
Section 1. Definitions
Dance Halls - A place of assembly, open to the public and
operated for profit, where dances, parties, receptions, and other
gatherings are held. Dance halls may provide live entertainment, may
serve alcoholic beverages, and may serve meals.
Bars – An area primarily devoted to the serving of alcoholic
beverages and in which the service of food is only incidental to the
consumption of such beverages.
Nightclub – A commercial establishment dispensing alcoholic
beverages for consumption on the premises and in which dancing and
musical entertainment is permitted.
Section 2. Hours of Operation – Any dance hall, bar, or
nightclub in the City of Holly Springs shall not operate between the
hours of 2:00 a.m. and 7:00 a.m. (Miss. Code 1972 Sec.
67-3-65).
Section 3. Liquor License – No licensee of the
Mississippi ABC Commission shall sell, dispense, deliver or permit the
removal of any alcoholic liquor to, on, or from any licensed premises
between the hours of 1:00 a.m. and 7:00 a.m. (Miss Code 1972 Sec.
67-3-53).
Section 4. Penalties – Any person, firm, or corporation
violating the provisions of this ordinance shall be fined not
more than $1,000 or imprisoned in jail not more than 30 days.
Section 5. All ordinances, or parts of ordinances in conflict
with this ordinance be and at the same time are hereby repealed. Should
any section, paragraph, sentence, clause or phrase of this ordinance be
declared unconstitutional or invalid for any reason, the remainder of
said or invalid for any reason, the remainder of said ordinance shall
not be affected thereby.
Section 6. The public good requiring it, this
ordinance shall take effect and be in force from and after its passage
and approval.
Said ordinance was introduced and was read and considered,
first section by section and then as a whole, and upon proper motion by
Alderman Payne, which motion was duly seconded by Alderman James, that
the said ordinance be adopted.
The ordinance was passed unanimously and is
effective immediately under Code Section 21-13-11; effective date of
ordinances; emergency measures.
