WHEREAS, on April 11, 2002, Angela Phillips-Sansone, a married person
and Anthony Sansone, a married man, executed a certain deed of trust to
First American Title, Trustee for the benefit of PHH Mortgage Services
which deed of trust is of record in the office of the Chancery Clerk of
Marshall County, State of Mississippi in Book 302 at Page 772; and
WHEREAS, PHH Mortgage Corporation DBA PHH Mortgage Services has
heretofore substituted J. Gary Massey as Trustee by instrument dated

NOTICE OF SALE
Sealed bids will be received by the Mississippi Department of
Transportation at the office of said Department, Jackson, Mississippi,
until 10:00 a.m. April 28, 2011, for the sale of:
One (1) Double Wide Mobile Home, located in the NE 1/4 of the SW 1/4,
of Section 24, Township 2 South, Range 5 West, Marshall County,
Mississippi. The property is located along the west side of Gravel Pit
Road near the city of Byhalia. The physical address is 290 Gravel Pit

TERMS OF SALE: The purchaser must completely remove said improvements
and all residue from the right of way within thirty (30) days after the
purchase. The purchaser shall be responsible for obtaining necessary
permits to move buildings over highways or streets, and each bidder
should investigate moving permit requirements before submitting bid.
All bids must be accompanied by a performance bond in the amount of ten
percent (10%) of the bid OR $500.00, whichever is greater. This bond
must be in the form of a CERTIFIED CHECK, CASHIER’S CHECK OR MONEY
ORDER OR BID BOND, and will be refunded if you are not the successful
bidder. However, if after reasonable time, the successful bidder fails
to remit the full amount of the bid, ten percent (10%) or $500.00,
whichever is greater, BID BOND will be forfeited. Cash or personal
check will NOT be accepted, and if attached will disqualify the bid.
The performance bond will be retained by the Department of
Transportation until the improvements and the residue from the
improvements excluding concrete slabs, are removed and the lot is
conditioned by the purchaser so as not to create an unsightly or
dangerous condition for either the neighborhood or the general public.
The Mississippi Department of Transportation shall have the right,
including the right of ingress and egress to appropriate the remaining
improvements and dispose the same.
The purchaser agrees to comply with the Rules and Regulations of the U.
S. Environmental Protection Agency as printed in 40 C.F.R. Part 61
pursuant to Section 112 of the Federal Clean Air Act, as amended, with
reference to Asbestos Removal.
All bids shall contain the statement: “I hereby certify that I am not
an employee or a member of an employee’s family and that I had no part
in appraising the above property nor in negotiating for its acquisition
by the Mississippi Department of Transportation.”
Pursuant to Section 25-4-103(h), State employees may not purchase
surplus property from any state agency, directly or indirectly.
The Purchaser shall not resell or transfer ownership of the
improvements unless written consent is obtained from the Department of
Transportation. Failure to obtain written consent shall void the
contract and the Performance Bond, and the purchase price shall be
forfeited.
The Department of Transportation reserves the right to reject any and

WHEREAS, on the 4th day of April, 2003, and acknowledged on the 4th day
of April, 2003, Annie L Cathey a/k/a Annie L. Wright, a separated
Woman, executed and delivered a certain Deed of Trust unto First
American Title, Trustee for PHH Mortgage Services, Beneficiary, to
secure an indebtedness therein described, which Deed of Trust is
recorded in the office of the Chancery Clerk of Marshall County,
Mississippi in Book 325 at Page 194; and
WHEREAS, on the 2nd day of August, 2010, the Holder of said Deed of
Trust substituted and appointed Emily Kaye Courteau as Trustee in said
Deed of Trust, by instrument recorded in the office of the aforesaid
Chancery Clerk in Instrument #2010003318; and
WHEREAS, default having been made in the payments of the indebtedness
secured by the said Deed of Trust, and the holder of said Deed of
Trust, having requested the undersigned so to do, on the 5th day of
May, 2011, I will during the lawful hours of between 11:00 a.m. and
4:00 p.m., at public outcry, offer for sale and will sell, at the south
door of the Marshall County Courthouse at Holly Springs, Mississippi,
for cash to the highest bidder, the following described land and
property situated in Marshall County, Mississippi, to-wit:
Lot 50 of Nonconnah Place Subdivision, Phase III of Section 24,
Township 1 South, Range 5 West, Chickasaw Cession, according to plat of
said subdivision recorded in Plat File No. 792A of the records of the
Clerk of the Chancery Court of Marshall County, Mississippi.
I will only convey such title as is vested in me as Substitute Trustee.
