of Availability of
Environmental
Assessment
The
USDA, Rural Utilities Service, has
received an application for financial assistance from the City of Holly
springs. As required by the National Environmental Policy Act, the
Rural Utilities Service has prepared an environmental assessment that
evaluated the potential environmental effects and consequences of the
proposed project. This notice announces the availability of the
Environmental Assessment for public review and comment.
The
proposed project consists of
construction of approximately 36.4 miles of 6” and
8” distribution
lines to be installed along the right-of-way of Marianna, Chulahoma and
side roads in the Marianna Community.
Copies
of the Environmental Assessment
are available for review at the Rural Development Area Office in
Batesville, MS. For further information contact:

OF TRUSTEE'S SALE
WHEREAS,
on the 5th day of July, 2001,
JANNIE B. LUELLEN, executed and delivered a Purchase Money deed of
trust to Diane G. Taylor, Trustee for the benefit of WILLIE
ANDERSON and wife, GENEVA ANDERSON, Beneficiary, which is recorded in

WHEREAS,

WHEREAS,
RONALD C. ANDERSON assigned
said deed of trust and promissory note to FIRST STATE BANK, by
assignment dated February 7, 2006 recorded in Power of Attorney Book 89
at page 210; and
WHEREAS,
FIRST STATE BANK re-assigned
said deed of trust and promissory note to RONALD C. ANDERSON, by
Re-assignment dated January 12, 2010, and recorded in Power of Attorney
Book as Instrument No. 2010000256 in the office of the

WHEREAS,
default having been made in
the terms and conditions of said deed of trust and the entire debt
secured thereby having been declared to be due and payable in
accordance with the terms of said deed of trust, and the legal holder
of said indebtedness, RONALD C. ANDERSON, having requested the
undersigned Trustee to execute the trust and sell said land and

On
or about February 22, 2010, the
above named City of Holly Springs will request the Mississippi
Development Authority to release funds under Title I of the Housing and
Community Development Act of 1974, amended, for the following project:
Project Description: City of Holly Springs/Marianna Community - Water
System Improvements along Marianna Road, South Banks Road, and
Chulahoma Road, providing service to 271 households that currently do
not have access to public water
FINDING
OF
NO
SIGNIFICANT IMPACT
It
has been determined that such
request for release of funds will not constitute an action that will
significantly affect the quality of human environment and accordingly,
the above named City of Holly Springs has decided not to prepare an
Environmental Impact Statement under the National Environmental Policy
Act (NEPA) of 1969 (PL 91-190).
The
reasons for such decision not to
prepare such a statement are as follows: The proposed activities will
have no adverse effect on the environment and the project will benefit
the area residents by improved water service to customers within City
of Holly Springs.
An
Environmental Review Record (ERR)
respecting the within project has been completed by the above named
City of Holly Springs which documents the environmental review of the
project and more fully sets forth why such statement is not
required. The Environmental Review record is on file at the
address listed above and is available for public examination and
copying between the hours of 8 a.m. - 5:00 p.m.
No
further environmental review of such
project is proposed to be conducted prior to the request for release of
federal funds.
PUBLIC
COMMENTS OF FINDINGS
All
interested agencies, groups, and
persons disagreeing with this decision are invited to submit written
comments for consideration by City of Holly Springs, 160 South Memphis
Street, Holly Springs, MS. Such written comments so received will be
considered by City of Holly Springs and City of Holly Springs will not
request the release of funds or take administrative action on the
within named project prior to the date specified in the preceding
sentence.
City
of Holly Springs will undertake
the project described above with grant funds from the Community
Development Block Grant Program and other loan and grant
funds. City of Holly Springs is certifying to the State that
the Board and Andre’ DeBerry in his capacity as Mayor consent
to accept
the jurisdiction of the federal courts if action is brought to enforce
responsibilities in relation to the environmental reviews, and that
these responsibilities have been satisfied under the National
Environmental Policy Act of 1969, as amended.
OBJECTION
TO STATE
RELEASE
OF FUNDS
The
State will accept an objection to
its approval only if it is one of the bases set forth in 24 CRF Part
58.76. Objections must be prepared and submitted in
accordance with the required procedures in 24 CRF Part 58 and may be
addressed to Dana Jones, Bureau Manager, Grants Management CSD, Post
Office Box 849, Jackson, MS 39205-0849, (Attention: Dana Jones).
Objections
to the release of funds on
bases other than those referenced above will not be considered by the
State. No objection received after March 12, 2010 will be
considered by the State.
