SUBSTITUTED TRUSTEE'S
NOTICE OF SALE
WHEREAS, on June 14, 2005, Raymond C.
Shipley & Cynthia A. Shipley, Husband & Wife, executed
a certain deed of trust to Jerry Baker, Trustee for the benefit of
Mortgage Electronic Registration Systems, Inc., which deed of trust is
of record in the office of the Chancery Clerk of Marshall County, State
of Mississippi in Book 384 at Page 35; and
WHEREAS, said Deed of Trust was
subsequently assigned to MidFirst Bank by instrument dated October 14,
2010 and recorded in Instrument No. 2010004519 of the aforesaid
Chancery Clerk's office; and
WHEREAS, MidFirst Bank has heretofore
substituted J. Gary Massey as Trustee by instrument dated October 25,
2010 and recorded in the aforesaid Chancery Clerk's Office in
Instrument # 2010004586; and
WHEREAS, default having been made in
the terms and conditions of said deed of trust and the entire debt
secured thereby having been declared to be due and payable in
accordance with the terms of said deed of trust, MidFirst Bank, the
legal holder of said indebtedness, having requested the undersigned
Substituted Trustee to execute the trust and sell said land and
property in accordance with the terms of said deed of trust and for the
purpose of raising the sums due thereunder, together with attorney's
fees, trustee's fees and expense of sale.
NOW, THEREFORE, I, J. Gary Massey,

GENERAL INFORMATION:
The described property will be sold by
sealed bid. All bids will be publicly opened in the office.

TO: The Known and Unknown Statutory
Wrongful Death Beneficiaries of Linda Carol Allen, Deceased, and the
Known and Unknown Heirs-at-law of Linda Carol Allen, Deceased, if they
are living and are non-residents of the State of Mississippi, or not to
be found therein after diligent search and inquiry, and whose places of
residence, post office, street and house addresses are unknown after
diligent search and inquiry to ascertain the same.
You have been made a Defendant in the
suit filed in this Court by Jimmy Allen, Petitioner, seeking to declare
the sole and only wrongful death beneficiaries and heirs-at-law of
Linda Carol Allen and seeking other relief.
You are summoned to appear and defend
against the Petition filed against you in this action at 9:30 o’clock
A.M. on the 14th day of January, 2011, in the Chancery Courtroom of the
Lafayette County Courthouse located in Oxford, Mississippi, and in case
of your failure to appear and defend, a Judgment will be entered
against you for the things demanded in the Petition.
You are not required to file an answer
or other pleading but you may do so if you desire.
