WHEREAS, it is found and determined by
the Mayor and Board of Aldermen of the City of Holly Springs,
Mississippi, that a change in the classification of certain real
property described herein, is necessary and advisable and in the best
interest of the municipality and its inhabitants, to change the zoning
classification for said property; and
WHEREAS, by previous ordinance,
amendments and changes were contemplated and allowed by giving at least
fifteen (15) days’ notice of a public hearing to consider any change or
amendment; and
WHEREAS, the City Board of Aldermen
did, on July 20, 2010, give notice of a public hearing to be held on

SECTION III. The property
described in this ordinance may be used in any manner provided for by
previous zoning ordinance consistent with the classification of B-4.
SECTION IV. The Clerk of the
City of Holly Springs is directed to publish a copy of this ordinance
in the local newspaper, The South Reporter, for one (1) week.
This ordinance shall be in full force and effect from thirty (30) days
after said publication.
The foregoing ordinance was introduced
and, upon motion by Alderman Bagley, duly seconded by Alderman Payne,
was discussed and considered, section by section, and then as a
whole. The motion was put to a roll call vote by the Mayor,

Mayor and Board of Aldermen of the City of Holly Springs, Mississippi,
for the Janitorial Services for the Holly Springs Utility Department,
in the office of the Clerk of said City, at City Hall at 160 South
Memphis Street, Holly Springs, Mississippi, until the hour of 5:30 p.m.
local time, November 16, 2010, at which time on said date, all bids
shall be publically opened and read aloud in the board room of said
Mayor and Board of Aldermen.
No bidder may withdraw a bid submitted
for a period of thirty (30) days after the date of opening such
bids. The City of Holly Springs reserves the right to reject
any and all b ids and to waive any informalities therein.
All bids shall be enclosed in an
envelope with “Bid for Janitorial Services” written on the outside.

WHEREAS, on June 5, 1998, Gwendolyn
Byers, a single person, executed a Deed of Trust to Charles M. Mooney,
Sr., Trustee for the use and benefit of First Home Mortgage, Inc.,
which Deed of Trust is on file and of record in the office of the
Chancery Clerk of Marshall County, Mississippi, in Deed of Trust Record
Book 237 at Page 329, thereof; and
WHEREAS, said Deed of Trust was
assigned to Associates Home Equity Services, Inc., by assignment on
file and of record in the office of the aforesaid Chancery Clerk in PA
Book 61 at Page 366 thereof; and
WHEREAS, the legal holder of the said
Deed of Trust and the Note secured thereby, substituted Lem
Adams, III, as Trustee therein, as authorized by the terms thereof, by
instrument recorded in the Office of the aforesaid Chancery
Clerk as Instrument No. 2010003864, thereof; and
WHEREAS, default having been made in
the performance of the conditions and stipulations as set forth by said
Deed of Trust, and having been requested by the legal holder of the
indebtedness secured and described by said Deed of Trust so to do,
notice is hereby given that I, Lem Adams, III, Substitute Trustee, by
virtue of the authority conferred upon me in said Deed of Trust, will
offer for sale and will sell at public sale and outcry to the highest
and best bidder for cash, during the legal hours (between the hours of
11 o'clock a.m. and 4 o'clock p.m.) at the South front door of the
Marshall County Courthouse at Holly Springs, Mississippi, on the 11th

the same land and property described in said Deed of Trust, situated in

Beginning at a point 500.0 feet East of Southwest corner of Section 13,

North 1 degree 10' 34" West 581.0 feet to a point; thence
North 89 degrees 43' East 150.0 feet to a point; thence South 1 degree
10' 34" East 581.0 feet to a point in the center of public road; thence

to the point of beginning and containing 2.0 acres, more or less.
Title to the above described property
is believed to be good, but I will convey only such title as is vested
