2006 and acknowledged on the 17th day of January, 2006, Lonzo Wilson,
Jr., as a single man, executed and delivered a certain Deed of Trust
unto Dennis L. Trent, Trustee for Mortgage Electronic Registration
Systems, Inc., Beneficiary, to secure an indebtedness therein
described, which Deed of Trust is recorded in the office of the
Chancery Clerk of Marshall County, Mississippi in Book 402 at Page 30;
and
WHEREAS, on 24th day of June, 2009,
Mortgage Electronic Registration Systems, Inc. as nominee for Oaks
Street Mortgage LLC, its successors and assigns, assigned said Deed of
Trust unto HSBC Mortgage Services, Inc., by instrument recorded in the
office of the aforesaid Chancery Clerk in Instrument# 2009003825; and
WHEREAS, on the 1st day of September,
2010 the Holder of said Deed of Trust substituted and appointed Emily
Kaye Courteau as Trustee in said Deed of Trust, by instrument recorded
in the office of the aforesaid Chancery Clerk in Instrument#
2010003836; and
WHEREAS, default having been made in
the payments of the indebtedness secured by the said Deed of Trust, and
the holder of said Deed of Trust, having requested the undersigned so
to do, on the 21st day of October, 2010, I will during the lawful hours
of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale
and will sell, at the south door of the Marshall County Courthouse at
Holly Springs, Mississippi, for cash to the highest bidder, the
following described land and property situated in Marshall County,

Commence at an iron pin at the

run thence South 674.42 feet to a point, thence run East 1897.18 feet
to a 1/2 inch rebar set, said being the Point of Beginning, run thence
North 89 degrees, 10 minutes, 27 seconds East 212.79 feet to a 1/2 inch
rebar set, run thence South 75 degrees, 55 minutes, 20 seconds East
130.92 feet to a 1/2 inch rebar set on the West right-of-way of Briscoe
road (SAP 47 (28)), run thence along said right-of-way the following
calls; South 07 degrees, 33 minutes, 25 seconds West 19.61 feet to a
1/2 inch rebar set, North 82 degrees, 26 minutes, 35 seconds West 25.00
feet to a 1/2 inch rebar set, South 10 degrees, 05 minutes, 59 seconds
West 124.32 feet to a 1/2 inch rebar set, thence along a curve to the
right with a delta angle of 04 degrees, 23 minutes, 54 seconds having a
radius of 646.20 feet and an arc length of 49.61 feet, with a chord
bearing and distance of South 11 degrees, 37 minutes, 10 seconds West
49.59 feet to a 1/2 inch rebar set, run thence South 89
degrees, 10 minutes, 27 seconds West leaving above mentioned
right-of-way 280.63 feet to a 1/2 inch rebar set, thence North 219.94
feet to the Point of Beginning.
Said tract containing 1.50 acres more
or less, according to a survey and a plot plan prepared by Perry D.
Young, #2665 reference to which is made in direct aid of this
description.
I will only convey such title as is vested in me as Substitute Trustee.

Ordinance of the Mayor and Board of Aldermen of the Town of Byhalia,
Mississippi prohibiting the purchase, possession, and sale, etc. of
synthetic cannabinoid, known commonly as “spice,” “K-2,” “Fire N Ice,”
and other synthetic products.
An Ordinance to prohibit synthetic
cannabinoid, etc.
BE IT ORDAINED by the Mayor and Board
of Aldermen of the Town of Byhalia, Mississippi as follows, to wit:
WHEREAS, the Mayor and Board of
Aldermen have the authority and power to make regulations to secure the
general health of the municipality, pursuant to Miss. Code Ann. Section
21-19-1(1), and
WHEREAS, the Mayor and Board of
Aldermen of the Town of Byhalia, Mississippi have determined that
certain businesses within the Town of Byhalia, Mississippi are selling,
or have attempted to sell, or may intend to sell, certain substances
which, when ingested, produce intoxicating effects similar to THC or
marijuana and/or Methcathinone, and
WHEREAS, the substances are not yet
categorized as illegal controlled substances under state or federal
law, and
WHEREAS, the substances, which are
described below, are often used as an alternative to marijuana and
other controlled substances and are potentially dangerous to users and
further, the long term effects are not yet known, and
WHEREAS, it has been determined that
the effects of these substances are a health concern to the citizens of
the Town of Byhalia, Mississippi.
NOW, THEREFORE, BE IT ORDAINED by the
Mayor and Board of Aldermen of the Town of Byhalia, Mississippi as
follows, to wit:
1. It is hereby declared to be unlawful
for any person to use, possess, purchase, attempt to purchase, sell,
publicly display for sale or attempt to sell or give, any one or more
of the following chemicals within the city limits of the Town of
Byhalia, Mississippi:
(A) Salviadivinorum or salvinorum A:
all parts of the plant presently classified botanically as salvia
divinorum, whether growing or not, the seeds thereof, an extract from
any part of such plant, and every compound, manufacture salts
derivative, mixture or preparation of such plant, its seeds or extracts;
(B) (6aR, IOaR)-9-(hydroxymethyl1)-6,
6dimethyl-3-(2-methyloctan-2-yl)-6a7;10.
10a-tetrahydrobenzo[c]chromen-1-01-some trade or other names; HU-210;
(C) 1-Pentyl-3-(1-naphthoyl)
indole-some trade or other names: JWH-018\ spice;
(D) 1-Butyl-3-(1-naphthoyl) indole-some
trade or other names: JWH-073;
(E) 1-(3-[trifluoromethylphenyl])
piperazine-some trade or other names: TFMIP;
(F) 4-methoxymethathione and
Ethylcathinone
(G) or any similar structural analogs.
2. If any of the aforementioned
substances are found in the possession of any person, the substances
may be confiscated and destroyed by law enforcement officials.
3. It is not an offense under Section 1
above of this Ordinance if the person was acting at the direction of an
authorized agent of the Town of Byhalia, Mississippi to enforce or
ensure compliance with this law prohibiting the sale of the
aforementioned substances.
4. This Ordinance does not apply to any
person who commits any act described in this Ordinance pursuant to the
direction or prescription of a licensed physician or dentist authorized
to direct or prescribe such act. This Ordinance likewise does not apply
to the inhalation of anesthesia for a medical purpose or dental purpose.
5. Any person found to be in violation
of this Ordinance will be guilty of a misdemeanor and subject to a term
of imprisonment not to exceed one year and/or a fine not to exceed
$1,000, and
6. Pursuant to Miss. Code Ann. Section
21-13-11, this Ordinance shall take effect immediately upon adoption,
in order to preserve the public peace, health, and safety against the
threat posed by the substances banned herein.
Upon motion by Alderman Mike Hamblin
and second by Alderman Rick DeBardeleben, with all in agreement,
passage of this Ordinance shall become official and shall take effect
one month from this date and be enforced according to law.

Notice to Bidders
Sealed proposals for the Holly Springs
Utility Department Renovations will be received by the Mayor and Board
of Aldermen of the City of Holly Springs, Mississippi, 160 South
Memphis Street at the Office of the Clerk of said City, in City Hall
until the hour of 5:30 p.m., local time, on November 2, 2010 at which
time on said date all proposals shall be publicly opened and read aloud.
A single bid will be reviewed for the
complete project. Contract documents, drawing and specifications are on
file in the office of the General Manager, Holly Springs Utility
Department, 1050 Highway 4 East, Holly Springs, Mississippi and may be
obtained therefrom.
Each bid must be accompanied by a
certified check or a bidder’s bond executed by the bidder and Surety
Company licensed to do business in the State of Mississippi in the sum
equal to five percent (5%) of the amount of the Lump Sum Bid.
No bidder may withdraw a bid submitted
for a period of thirty (30) days after the date of opening such bids.
