executed a Purchase Money Deed of Trust, recorded in Marshall County,

2009002133, conveying hereinafter described land to Lynda M.
Davis, Trustee, securing their note to Oliver M. Burch IV.
Debtor defaulted and legal holder

D. Waller, an unmarried person, executed a certain deed of trust to
First American Title, Trustee for the benefit of Mortgage Electronic
Registration Systems, Inc. which deed of trust is of record in the
office of the Chancery Clerk of Marshall County, State of Mississippi
in Book 449 at Page 741 and re-recorded in Instrument No. 2010002798;
and
WHEREAS, Ricardo D. Waller, Alex Chonta
Anderson and Elizabeth C. Anderson, as joint tenants with rights of
survivorship, and not as tenants in common, acquired title of said Deed
of Trust by Warranty Deed dated January 22, 2008 and recorded in
Instrument Number 2008000432 of the aforesaid Chancery Clerk's Office;
and
WHEREAS, said Deed of Trust was
subsequently assigned to PHH Mortgage Corporation by instrument dated
March 25, 2009 and recorded in Instrument No. 2009001866 and by
instrument dated August 26, 2010 and recorded in Instrument No.
2010003729 of the aforesaid Chancery Clerk's office; and
WHEREAS, PHH Mortgage Corporation has
heretofore substituted J. Gary Massey as Trustee by instrument dated

WHEREAS, default having been made in

On October 5, 2006, DAVID COOK,
executed a Purchase Money Deed of Trust, recorded in Marshall County,
Holly Springs, Mississippi land records, Land Trust Deed Book 422, Page
273 conveying herein after described land to Lynda M. Davis, Trustee,
securing their note to Mary W. Hurdle, individually and Mary Ann
Hurdle, Trustee for the Rachel E. Hurdle, Trust, and W. Warren
Callicutt per instrument recorded in land deed record book 339, page
701, Marshall County, MS.
On May 12, 2008, Mary W. Hurdle,
individually and as Trustee for the benefit of Rachel E Hurdle and W.
Warren Callicutt, assigned all their interest in the above mentioned
deed of trust to Moore Plantation, LLC. Said assignment is
recorded in the land records of Marshall County, Mississippi as
instrument number 2008002771.
On May 12, 2008 Moore Plantation LLC
assigned their interest in the above mentioned deed of trust to First
State Bank as collateral. This assignment has been released
by document dated August 17, 2009 and recorded as instrument number
2010003605.
Debtor defaulted and legal holder
accelerated the note and requested foreclosure.
As Trustee, in lawful hours, at the
South door of Marshall County, Mississippi Courthouse on October 20,
2010, I will sell to highest cash bidder at public outcry the following
