will meet for their regular scheduled meeting on Thursday, April 8,
2010, at 2:00 p.m. in the Marshall County Zoning Office at 590 Old
Highway 78-East, Holly Springs,Mississippi. The public is invited to

The following requests will be on the
agenda:
ITEM 1: Mr. Jeremy Dalton at 207 Jones
Brothers road requests to be allowed to place a second dwelling (single
wide mobile home) on his property for his mother and her husband. If
allowed, the mobile home will be placed on the property where it will
not be seen from most of the neighbors. This request is being made
because his mother’s husband is disabled and her health is failing and
she needs to be close to him (Jeremy) for help with daily tasks. The
property in question is Lot #11 of Sam Frank Jones Estate, contains
approximately 9.25 acres and is zoned Agricultural.
ITEM 2: Rezoning Hearing at 3:00 p.m.

TO WHOM IT MAY CONCERN: The
application described below has been submitted for an Aquatic Resource
Alteration Permit under The Tennessee Water Quality Control Act of
1977, T.C.A. §69-3-108. In addition, federal permits may be required
from the U. S. Army Corps of Engineers and the Tennessee Valley
Authority under §404 of the Clean Water Act and §26a of the Tennessee
Valley Authority Act, respectively. Section 401 of the Clean Water Act
requires that an applicant obtain a water quality certification from
the state when a federal permit is required. This notice may cover
applications subject to §401.
No decision has been made whether to
issue or deny this permit. The purpose of this notice is to inform
interested parties of this permit application and to ask for comments
and information necessary to determine possible impacts to water
quality. Persons wishing to comment on the proposal are invited to
submit written comments to the department. Written comments must be
received within thirty days of the date that this notice is posted.
Comments will become part of the record and will be considered in the
final decision. The applicant’s name and permit number should be
referenced.
The permit application, supporting
documentation including detailed plans and maps, and related comments
are available for review and/or copying at the department’s natural
resources section.
Interested persons may also request in
writing that the department hold a public hearing on this application.
The request must be filed within the comment period, indicate the
interest of the person requesting it, the reasons that the hearing is
warranted, and the water quality issues being raised. When there is
sufficient public interest in water quality issues, the department
shall hold a public hearing in accordance with Rule 1200-4-7-.04(4)(f).
In deciding whether to issue or deny a
permit, the department will consider all comments of record and the
requirements of applicable federal and state laws. In making this
decision, a determination will be made regarding the lost value of the
resource compared to the value of any proposed mitigation. The
department shall consider practicable alternatives to the alteration.
The department shall also consider loss of waters or habitat,
diminishment in biological diversity, cumulative or secondary impacts
to the water resource, and adverse impact to unique, high quality, or
impaired waters.

WATERSHED DESCRIPTION: The
proposed impacts would affect first and second order unnamed
tributaries to the Wolf River. The streams flow through a generally
well defined channels of variable width flowing generally to the north
toward SR-57. The streams vary in depths up to 8 inches flowing over a
gravel/silt/sand substrate and have a generally full canopy of mature
hardwoods throughout. The land use in the area is rural agricultural.
PROJECT DESCRIPTION: The
project would involve the construction of a combined rail yard and
associated truck pads for a regional intermodal transportation
facility. The project would involve permanent impacts to 2.24
acres of wetlands; 4,738 ft. of stream relocations, encapsulation,
and/or elimination; and impacts to four ponds on 650 acres south of
SR-57. The primary connector would involve a switch north of SR-57
crossing south along a straight course with a turnaround loop. The
facility entrance for highway traffic would approach from the south on
US-72 and is not projected to add traffic loading to SR-57.
Specific impacts are listed below. Stream 2: (At SR-57): Proposed
culvert extension of existing crossing by 19 ft. plus 15 ft. of bank
stabilization. Stream 3: Proposed 310’ of 48” culvert beneath lead
track plus 101’ of bank stabilization. Stream 4: Proposed 908’ of rock
fill of upmost portion of headwater stream to conduct groundwater along
original course subsurface. Stream 5: impacted at multiple locations:
Proposed 3,008’ would be encapsulated and/or eliminated including
elimination of an in stream pond plus 30 ft. of riprap stabilization.
Stream 5 will also be encapsulated for the lead track crossing (42’
culvert and 60’bank stabilization and a culvert extension at SR-57
(proposed 59’ culvert extension plus 47’ bank stabilization. Stream 6:
Proposed 2 bridges: 1 @ 48’ and the second @ 91’. Wetland 3: Proposed
permanent fill of 0.4 acre. Wetland 5: Proposed permanent fill of 0.21
acre. Wetland 6: Proposed permanent fill of 0.1 acre. Wetland 7:
Proposed permanent fill of 0.77 acre. Wetland 8: Proposed permanent
fill of 0.57 acre. Wetland 10: Proposed permanent fill of 0.64 and
temporary impact to 0.02 acre of wetlands. Pond 1 and 3 would be
filled. Pond 4 would be filled/encapsulated to accommodate loop track
with an equalization pipe beneath to allow flow to either side of the
track.
Impacts to wetlands would be mitigated
by debiting, at a 2:1 ratio, 4.5 acres from available credit at the
Wolf River Wetland Mitigation Bank. Impacts to 4,297’ of stream would
be mitigated through payment ($200/linear foot) of $859,400.00 and 60’
would be mitigated ($150/linear foot) through payment of $9000 to the
Tennessee In-lieu Fee Stream Mitigation Program Other impacts would be
covered under General Permit and would not require additional
mitigation.

SAID AMENDMENT
WHEREAS, the Mayor and Board of
Aldermen of the City of Holly Springs, Mississippi, have determined to
amend Article 14 Signs of the Comprehensive Zoning Regulations to read
as follows:
“Section 14.2 Definitions add the
following: Special Events Signs – A sign advertising display that is
temporary in nature, is not permanently attached to the ground or sign
surface, and is used for special events, such as, but not limited to,
grand openings, seasonal sales, liquidations, going-out-of-business
sales, and promotions.
Section 14.3 Special Events signs shall
be allowed for no more than 30 days in a calendar year.”

Lemay and Kimberly Nicole Sanders Lemay executed and delivered a

WHEREAS, on August 28, 2006, TGM, LLC,
a Tennessee Limited Liability Company executed a Deed of Trust to James
E. Woods, Trustee for the benefit of Earline Hill, which Deed of Trust
