Public Notice
The Marshall County Planning Commission
will meet for their regular scheduled meeting on Thursday, March 12,
2009, at 2:00 p.m. in the Marshall County Zoning Office at 590 Old
Highway 78-East, Holly Springs, Mississippi. The public is invited to
attend.
The following requests will be on the
agenda:
ITEM 1: Mr. Mark P. Mathis on behalf of
Slayden Baptist Church located at 2534 Highway 72 is requesting to be
allowed to establish a daycare at the church. If this request is
allowed, the daycare will be operated Monday-Friday, 7:00 a.m. - 7:00
p.m. The property in question contains approximately 16 acres and is
zoned R-E.
ITEM 2: Mr. and Mrs. Demetrius
Cornelious at 99 Moore Loop are requesting to be allowed to construct a
30x50 garage/storage building on their property to be used to store
work equipment and a vehicle. The property in question is Lot 48 of

WHEREAS, on September 12, 2005, Sandie
L. Crum and Evelyn Mayse executed a promissory note payable to the
order of Novastar Mortgage, Inc.; and
WHEREAS, the aforesaid promissory note
was secured by a Deed of Trust dated September 12, 2005, executed by
Sandie L. Crum and Evelyn Mayse, and being recorded in Book 391, Page
467 of the records of the Chancery Clerk of Marshall County,
Mississippi; and which aforesaid instrument conveys to Robert S.
Coleman, Jr., P.A., Trustee, the hereinafter described property; and
WHEREAS, Mortgage Electronic
Registration Systems, Inc., as nominee for Novastar Mortgage, Inc.
having executed a Substitution of Trustee to substitute Floyd Healy as
trustee in the place and stead of Robert S. Coleman, Jr., P.A., the
same having been recorded as Instrument No. 2009000596 of the records
of the Chancery Clerk of Marshall County, Mississippi; and
WHEREAS, default having occurred under
the terms and conditions of said promissory note and Deed of Trust and

WHEREAS, on May 24, 2005, Tracy Black
aka Tracy L. Black and wife, Brandy K. Black, executed a certain deed
of trust to Jim B. Tohill, Trustee for the benefit of Ameriquest
Mortgage Company, which deed of trust is of record in the office of the
Chancery Clerk of Marshall County, State of Mississippi in Book 383 at
Page 343 and re-recorded as Instrument No. 2008000128; and
WHEREAS, said Deed of Trust was
subsequently assigned to Deutsche Bank National Trust Company, as
Trustee of Ameriquest Mortgage Securities, Inc. Asset-Backed
Pass-Through Certificates, Series 2005-R6 under the Pooling and
Servicing Agreement dated as of July 1, 2005, without recourse, by
instrument dated January 30, 2008 and recorded as Instrument No.
2008000936 of the aforesaid Chancery Clerk's office; and
