NOTICE OF ZONING HEARING OF PROPOSED
AMENDMENT TO THE ZONING ORDINANCES
OF THE CITY OF HOLLY SPRINGS AND
MARSHALL COUNTY, MISSISSIPPI
Notice is hereby given to any and all
persons interested in or in any way affected thereby that the Marshall
County Industrial Development Authority has filed an application with
the Zoning Administrators of Marshall County and the City of Holly
Springs to amend the Official Zoning Ordinances to add an Airport
Overlay Zone District.
A copy of said Airport Overlay Zone
District is on file with the Zoning Administrators of both political
bodies and is available for review during normal business hours.
Said application and proposed amendment
will come before the Board of Supervisors and the Board of Aldermen for
a joint public hearing on March 9, 2009, at 9:00 a.m. The
meeting will be held at the Marshall County Board Room, Courthouse
Square, Market Street, Holly Springs, Marshall County, Mississippi.
Any person desiring to express his or
her views on the proposed amendment may be present and do so at said
hearing or may deliver his or her written statement to one of the
Zoning Administrators, prior to said hearing. Written
statements so delivered shall be made part of the record of said
hearing. All inquiries about the application and proposed
amendment should be addressed to one of the Zoning Administrators
listed below.

SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on September 3, 1999, Odis J.
Reliford and Wife, Jovetta Reliford executed a certain deed of trust to
Rowan H. Taylor Jr., Trustee for the benefit of Cendant Mortgage
Corporation which deed of trust is of record in the office of the
Chancery Clerk of Marshall County, State of Mississippi in Book 255 at
Page 671 and re-recorded in Book 267 at Page 169; and
WHEREAS, said Deed of Trust was
subsequently assigned to MidFirst Bank by instrument dated December 5,
2003 and recorded in Book PA81 at Page 494 and re-recorded as
Instrument No. 2009000375 of the aforesaid Chancery Clerk's office; and
WHEREAS, MidFirst Bank has heretofore

Marshall County has been awarded Federal funds under the Emergency
Shelter National Board Program
Marshall County has been chosen to
receive $34,013.00 to supplement emergency food and shelter programs in
the county.
The selection was made by a National
Board that is chaired by the Department of Homeland
Security’s Federal Emergency Management Agency and consists
of representatives from American Red Cross, Catholic Charities, USA;
National Council of the Churches of Christ in the U.S.A., The Salvation
Army; United Jewish Communities, and United Way of America. The Local
Board was charged to distribute funds appropriated by Congress to help
expand the capacity of food and shelter in the high-need areas around
the country.
A Local Board made up of various
Marshall County Community Agencies Representatives will determine how
the funds to Marshall County are to be distributed among the emergency
food and shelter programs run by the local service agencies in the
area. The Local Board is responsible for recommending agencies to
receive these funds and any additional funds available under this phase
of the program.
Under the terms of the grant from the
National Board, local agencies chose to receive funds must: (1) be
private voluntary non-profits or units of government (2) have an
accounting system (3) practice non-discrimination, (4) have
demonstrated the capability to deliver emergency food and/or shelter
programs, and (5) if they are a private voluntary organization, they
must have a voluntary board. Qualifying organizations are urged to
apply.
Marshall County has distributed
Emergency Food and Shelter funds previously with Marshall County
Community Development Corporation, Meals on Wheels, Starfish
Ministries, Catholic Community Outreach, and Northeast Mississippi
Community Services participating. These agencies were responsible for
providing 2500 meals and 89 nights of lodging.
Public or private voluntary agencies
interested in applying for Emergency Food and Shelter Program funds
must contact Marilyn Curry, Post Office Box 5342, Holly Springs, MS
38634, 662-252-4688 for an application. The deadline for applications
to be received is February 19, 2009.

WHEREAS, on the 5th day of February,
2000 and acknowledged on the 5th day of February, 2000, Jimmy Lee
Donnell and wife Dorothy Donnell, executed and delivered a certain Deed
of Trust unto Robert Frappier, Trustee for Emmco The Mortgage Service
Station, Inc., Beneficiary, to secure an indebtedness therein
described, which Deed of Trust is recorded in the office of the
Chancery Clerk of Marshall County, Mississippi in Book 261 at Page 837;
and
WHEREAS, by various assignments on
record said Deed of Trust was ultimately assigned to Bank of America,
N.A. sbm to LaSalle Bank National Association as Trustee for RAMP
2007RP3, by instrument recorded in the office of the aforesaid Chancery
Clerk in Instrument # 2009000433; and
WHEREAS, on the 28th day of January,
2009, the Holder of said Deed of Trust substituted and appointed Emily
Kaye Courteau as Trustee in said Deed of Trust, by instrument recorded
in the office of the aforesaid Chancery Clerk in Instrument #
2009000450; and
WHEREAS, default having been made in
the payments of the indebtedness secured by the said Deed of Trust, and
the holder of said Deed of Trust, having requested the undersigned so
to do, on the 5th day of March, 2009, I will during the lawful hours of
between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and
will sell, at the south door of the Marshall County Courthouse at Holly
Springs, Mississippi, for cash to the highest bidder, the following
described land and property situated in Marshall County, Mississippi,
to-wit:
Beginning at a point on the Northwesterly right-of-way line of
Mississippi State Hwy # 7, a distance of 350 feet, more or less, (as
measured along said right-of-way line) Southwesterly from the East line
of Section 4, Township 3 South, Range 2 West, Marshall County,
Mississippi; thence Southwesterly along said right-of-way line, 150
feet; thence West, along Melvina Reason Spight's South line, 290.5
feet; thence Northeasterly parallel with said right-of-way line, 150
feet; thence East 290.5 feet to the Point of Beginning, Containing 1
acre, more or less.
I will only convey such title as is vested in me as Substitute Trustee.

Contract time is 45 Working Days. Contractor shall commence work on or
before a date to be stipulated in the Notice to Proceed.
Basis of Award: The award, if made,
will be made to the lowest qualified Bidder on the basis of estimated
quantities contained in the Proposal. All Bids must be made on the
Proposal Form contained in the Contract Documents.
Should no award be made within Sixty
(60) calendar days after opening of proposals, all proposals may be
rejected and all proposal guaranties returned, unless the lowest
responsible bidder, at the request of the Owner, agrees in writing to a
longer delay.

attached, or Cashier’s check or Certified check for five
percent (5%) of the total bid, payable to Town of Byhalia, Mississippi,
must accompany each proposal.
Bidders are hereby notified that any
proposal accompanied by letters qualifying in any manner the condition
under which the proposal is tendered will be considered an irregular
bid, and such proposals may not be considered in making the
award. The Owner reserves the right to waive any
irregularities and to reject any and all bids if considered not in the
best interest of the Owner.
