time and date so designated for the opening by may not be thereafter
withdrawn for thirty (30) days.
The Marshall County Board of
Supervisors reserves the right to determine which is the lowest and
best bid and to accept or reject any or all bids on any part of any or
all bids based on that determination.
Prices bid shall be firm without
reservation as to change subsequent to date of bid opening and shall
remain so for the duration of the Contract as set forth in
the specifications. In the event that no Item Contract is
involved, orders shall be placed with successful bidder within thirty
(30) days of the bid opening or this clause shall be considered void.
It shall be incumbent upon each
bidder
to understand the specifications as listed herein and to obtain
clarification when necessary. It is not the intent of the
specifications to limit the bidding to any make or manufacture of
equipment or items of commodity, but rather to select such equipment
and/or commodities to fill a specific need and perform a specific task.
Any reference to name brand equipment or commodities is intended to
establish standards only and bids submitted on equipment and
commodities equal thereto shall be received and considered.
The bidder agrees to all

forth above and agrees to deliver those items, on which he is the

the aforesaid Chancery Clerk in Instrument # 2009004496; and
WHEREAS, on the 25th day of
September,
2006, the Holder of said Deed of Trust substituted and appointed Emily
Kaye Courteau as Trustee in said Deed of Trust, by instrument recorded
in the office of the aforesaid Chancery Clerk in Book 421 at Page 511;
and
WHEREAS, default having been made
in
the payments of the indebtedness secured by the said Deed of Trust, and
the holder of said Deed of Trust, having requested the undersigned so
to do, on the 12th day of November, 2009, I will during the lawful
hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for
sale and will sell, at the south door of the Marshall County Courthouse
at Holly Springs, Mississippi, for cash to the highest bidder, the
following described land and property situated in Marshall County,
Mississippi, to-wit:
Commencing at an iron pipe recognized as the northeast corner of the
southeast quarter of Section 29, Township 5 South, Range 1 West,
Marshall County, MS, and run thence West for 1633.01 feet, thence run
south for 1230.37 feet to an iron pin on the west right of way line of
Mississippi Highway No. 349 for a P.O.B.; thence run north 54 degrees
01' west for 208.71 feet to an iron pin; thence run south 37 degrees
00' west for 208.00 feet to an iron pin; thence run south 54 degrees
00' 43`94 east for 209.86 feet to an iron pin on the west right of way
line of said highway; thence run easterly along the west right of way
line of said highway in a 6 degree curve to the left, having a radius
of 954.93 feet for a 208.41 feet to the point of beginning, containing
one and two-hundredths (1.02) acres, more or less, and being
situated in the southeast quarter of Section 29, Township 5 South,
Range 1 West, Marshall County, MS.
This being the same property as
conveyed by Christopher E. Johnson to Christopher E. Johnson and Harry
Vinson, in Warranty Deed Book 263, Page 233, dated 11/6/95 and recorded
11/15/95, in the Chancery Clerk's office of Marshall County, MS.
I will only convey such title as is vested in me as Substitute Trustee.
