There came on for hearing and consideration by the Board of Supervisors
of Marshall County on this the 14th day of September, 2009, the matter
of levying the ad valorem taxes for the fiscal year 2009–2010 on
assessments of property as of January 1, 2009, for the County, the Road
District, the School District, and for all other taxing districts, and
fixing the tax rate of levy for the county and the districts, as stated
in accordance with the provisions of Section 27-39-217, Mississippi
Code of 1972, and other laws relative to said matter; and the Board
having fully considered the needs and requirements of the various funds
of the county and of the districts and the rates of levying which are
required to produce the revenue necessary to meet the budget as made
fixed and heretofore approved by this Board as required by law and it
having been ascertained that the maintenance levy for the county wide
school district is supported by proper and necessary petition as
required by law; and it appearing that the tax rate of levies for the
county wide and several county purposes, the road district, the school
district, and other taxing districts are necessary in order to raise
the funds required to meet the expenses of the county, and of said
taxing districts for said fiscal year.
IT IS THEREFORE, ORDERED AND ADJUDGED BY THE BOARD OF SUPERVISORS OF
MARSHALL COUNTY, MISSISSIPPI that the following ad valorem tax rates or
levies be and the same are hereby imposed and levied for the fiscal
year 2009-2010 upon the assessed value of all taxable property in
Marshall County, State of Mississippi, and in respective road
districts, school districts, and all other taxing districts in Marshall
County as the property is now assessed and listed or as may hereinafter
be assessed and listed upon the assessment rolls of said county as of
January 1, 2009 (except the exempt assessed values of homes to be
exempt by “The Homestead Exemption Act of 1946”), and said expressed
rates in mills or in decimal fraction of a mill being levied and
imposed upon each dollar of assessed valuation appearing upon the
assessment rolls of said County as aforesaid for the following funds or
purposes; and, when the money is collected it shall be credited to the
respective funds as provided by law.
SECTION 1. There is hereby levied upon each dollar of
assessed value in the County for county-wide purposes, as follows:

by Sections 27-39-303, 41-19-39, 39-3-35, 43-31-15, 17-1-37, 19-9-97,

SECTION 2. There is hereby levied on all timbered and
uncultivated land in the county a special tax to be known as “The
Forest Acreage Tax” in the amount of nine cents ($0.09) per acre on
each of such timbered and uncultivated land, as authorized by
Section 49-19-115 .09
There is hereby levied upon each dollar of assessed valuation of
taxable property in the Marshall County School District for
supplementing teachers’ salaries, extending school terms, purchasing
furniture, supplies and materials, and all other lawful operating and
incidental expenses of said school district funds for which are not
provided by minimum program fund allotments, as authorized by Section
37-57-105, as follows:

SECTION 3. There is hereby levied and imposed upon each

SECTION 4. There is hereby levied on all industries granted
an ad valorem tax exemption, from and after the 14th day of April, 1999
two (2) mills for Police Protection and two (2) mills for Fire
Protection. This being authorized by House Bill No. 1727,
dated April 14, 1999, under Section 27-31-101, Mississippi Code of
1972, as amended.

SECTION 6. It is further ordered by the Board of Supervisors
that all ad valorem taxes hereby levied and empowered are fixed within
the limits as stated in Chapter 30, Title 27 of the Mississippi Code of
1972, as amended, the general county taxes being governed by Section
27-39-317, Mississippi Code of 1972, and the school district taxes by
Title 37 of the Mississippi Code of 1972, as amended.
SECTION 7. It is further ordered that all monies received and
collected by the Tax Assessor and Collector and paid by him to the
proper fund according to the provision of the order shall be credited
to the designated fund by the County Auditor, in accord with the budget
as heretofore adopted by this Board, and shall be expended in the
manner and for the purpose set forth in said budget and for no other
reason.
SECTION 8. It is further ordered that the Clerk of the Board
of Supervisors be and is hereby expressly directed to comply with all
of the requirements of law prescribed by Title 27 of the Mississippi
Code of 1972, as amended, relating to the certification of the ad
valorem rates or levies heretofore made and fixed.

The Marshall County Planning Commission
will meet for their regular scheduled meeting on Thursday, October 8,
2009, at 2:00 p.m. in the Marshall County Zoning Office at 590 Old
Highway 78-East, Holly Springs,Mississippi. The public is invited to
attend.
The following requests will be on the
agenda:
ITEM 1: Mr. Michael T. Birk is
requesting to be allowed to operate a small business (curing and
preserving fresh foods) for retail resale out of a separate building on
his property located at 219 Lynett Drive. If allowed, Mr. Birk will be
the only employee and there will be no customers coming to the
property. The property in question is Lot #6 of Hughey Jones Farms
Subdivision, contains three (3) acres and is zoned R-E.
ITEM 2: Mr. Marion Threatt on behalf of
Signal Source Company is requesting to be allowed to construct a 300’
(100x100 compounds) communication tower on property owned by Casey
Hillmer, Tamara Hillmer and John DeHart. The property in question is
located on Jeffries Road, contains seventeen (17) acres and is zoned
Agricultural.
ITEM 3: Mr. Dustin L.Greer is
requesting to be allowed to construct a metal building (18x21) on his
property located on Plantation Way (Lot #53 of Victoria Plantation
Subdivision) before building his home (he’s planning to build his home
in a year). If the request is allowed, the building will be used to
store his tractor. The property in question contains 2.31 and is zoned
R-1.
ITEM 4: Mr. and Mrs. Clayton Brown are
requesting to be allowed to place a second dwelling (double wide mobile
home) on his mother’s (Charlotte Brown) property located at 1668
Wildcat Bottom Road. This request is being made because of his mother’s

ITEM 5: Mr. Jerry Rush requests to be

ITEM 6: Mrs. Dorothy Cox is requesting
to be allowed to open a convenience store at the old Marshall Scruggs
building (previously owned by her great uncle Marshall Scruggs) located
at 1942 Old Highway 4 West. The property in question is zoned
Agricultural.
ITEM 7: Mr. and Mrs. Henry Martin Jr.
at 94 Laws Hill Road are requesting to be allowed to place a second
dwelling (single wide mobile home) on their property for their
grandson, Sevestin Martin and his family. If the request is allowed,
Mr. and Mrs. Martin home fronts Laws Hill Road and the mobile home will
be placed to the back of the property that fronts Highway 4 West. The
property in question contains 1.8 acres and is zoned R-1.
ITEM 8: Mr. Ronnie Wilkerson owner of
American Towing Services is requesting to be allowed to store vehicles
up to thirty (30) days on his property located at 5662 Highway 178 West
(Victoria). If the request is allowed, the vehicles will be stored
behind an eight (8) foot fence. The property in question is Lot 3 of
Victoria Heights North Subdivision, contains 1.89 acres and is zoned
R-2.
ITEM 9: Ms. Carolyn Boyce is requesting
to be allowed to place a 1999, double wide mobile home on Lot #5 of
Tunstall Valley Subdivision (Valley Cove). This request is being made
because the covenants states all double wide mobile homes shall be no
older than 5 years old at the time of placement on the property. The

SUBSTITUTE TRUSTEE'S
NOTICE OF SALE
STATE OF MISSISSIPPI
COUNTY OF MARSHALL
WHEREAS, on September 30,
1999, Walker Byrd Jr and Sara Ann Byrd executed and delivered a certain
Deed of Trust unto R. Gattan Brown, Jr., Trustee for the benefit of
National Bank of Commerce, to secure an indebtedness therein described,
which Deed of Trust is recorded in the office of the Chancery Clerk of
Marshall County, Mississippi in Book 256, Page 696; and
WHEREAS, the holder of said Deed of
Trust substituted and appointed Nationwide Trustee Services, Inc., as
Trustee in said Deed of Trust by instrument recorded in the Office of
the aforesaid Chancery Clerk in Instrument 2009003865; and
WHEREAS, default having been made in
the payments of indebtedness secured by said Deed of Trust, and the
holder of said Deed of Trust, having requested the undersigned so to
do, on October 15, 2009, I will, during legal hours (between the hours
of 11 o' clock a.m. and 4 o' clock p.m.), at public outcry, offer for
sale and will sell, at the South door of the Marshall County Courthouse
in Holly Springs, Mississippi, for cash to the highest bidder, the
following described land and property situated in Marshall County,
Mississippi, to-wit:
Commence at a 3/4 " pipe and fence
corner at the Northeast corner of the Southwest Quarter of Section 32,
Township 5 South, Range 1 West, Marshall County, Mississippi; thence
run South 89° 28' 04" West for 1322.57 feet to an iron bar; thence run
South 00° 01' 30" West for 264.0 feet to an iron pipe; thence continue
South 00° 02' 18" West for 23.0 feet to an 1" pipe; thence run North
67° 45' West for 237.6 feet to an iron rod at the point of
beginning for herein described parcel ; thence run South 23° 25' West
for 192.8 feet to an iron rod; thence run North 80° 30' West for 117.0
feet to an iron rod; thence run North 29° 09' West for 313.8 feet to a
fence corner on the South side of drive and the East right of way of
Highway No. 349; 40.0 feet from centerline; thence with said right of
way run North 29° 30' East for 23.0 feet to an iron rod; thence leaving
said right of way run South 67° 45' East for 360.4 feet to the point of
beginning, containing 1.23 acres, more or less.
Title to the above described property is believed to be good, but I
will convey only such title as is vested in me as Substituted Trustee.
