The Complaint against you, which is on
file at the Marshall County Chancery Court, Holly Springs, Mississippi,
in the above numbered cause, is important and you must take immediate
action to protect your rights.
You are required to mail or hand
deliver a written response to the Complaint filed against you in this
action to John C. Morris, III, Attorney for Plaintiff, whose address is

YOUR RESPONSE MUST BE MAILED OR DELIVERED NOT LATER THAN THIRTY DAYS

WHEREAS, on the 27th day of January,
2004, Elizabeth H. Jones, a single person, executed and delivered a
certain Deed of Trust unto Gregory L. Gregg, Trustee for Mortgage
Electronic Registration Systems, Inc., Beneficiary, to secure an
indebtedness therein described, which Deed of Trust is recorded in the
office of the Chancery Clerk of Marshall County, Mississippi in Book
350 at Page 260; and
WHEREAS, on the 10th day of December,
2008, Mortgage Electronic Registration Systems, Inc., assigned said
Deed of Trust unto The Bank of New York Mellon Trust Company, National
Association fka The Bank of New York Trust Company, N.A. as successor
to JPMorgan Chase Bank N.A. as Trustee for RAMP 2004RS4, by instrument
recorded in the office of the aforesaid Chancery Clerk in Instrument
#2008006711; and
WHEREAS, on the 10th day of December,
2008, the Holder of said Deed of Trust substituted and appointed Emily
Kaye Courteau as Trustee in said Deed of Trust, by instrument recorded
in the office of the aforesaid Chancery Clerk in Instrument
#2008006730; and
WHEREAS, default having been made in
the payments of the indebtedness secured by the said Deed of Trust, and
the holder of said Deed of Trust, having requested the undersigned so
to do, on the 22nd day of January, 2009, I will during the lawful hours
of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale
and will sell, at the south door of the Marshall County Courthouse at
Holly Springs, Mississippi, for cash to the highest bidder, the
following described land and property situated in Marshall County,
Mississippi, to-wit:
Land situated in Marshall County Mississippi to wit:
Lot 5 of Whitten Farms Subdivision, in
Section 13 and 14, Township 3 South, Range 3 West, Marshall County
Mississippi, according to the plat of said subdivision filed in Plat
File 851A of the records of the Chancery Clerk of Marshall County
Mississippi, to which plat reference is hereby made for a more
particular description of said lot.
Being the same property conveyed to
grantor, Marcus C. Hicks and wife Chiquita D. Hicks, herein by Warranty
Deed of record at book 316, Page 55, dated February 20, 2001, filed
February 23, 2001, in the Chancery Clerk's Office of Marshall County
Mississippi.
I will only convey such title as is vested in me as Substitute Trustee
