NOTICE OF SUBSTITUTE TRUSTEE'S SALE OF

Under and by virtue of the authority
vested in me as Substitute Trustee in that certain Deed of Trust
dated Deed of Trust dated September 22, 2006 executed by
Gayle P. Work to Jennifer L. Shackelford as Trustee, for the use and
benefit of Merchants and Farmers Bank recorded in Land Deed of Trust
Book 422 pages 338-343;
Deed of Trust dated April 3, 2007
executed by Gayle P. Work to Jennifer L. Shackelford as
Trustee, for the use and benefit of Merchants and Farmers Bank recorded
in Land Deed of Trust Book 435 pages 722-727; all in the records of the
office of the Chancery Clerk of Marshall County, Mississippi;
the undersigned was appointed as Substitute Trustee by instrument dated
November 25, 2008 recorded in the land records of the
Marshall County Chancery Clerks Office as Instrument No. 2008006433;
and default having been made in the payment of the indebtedness thereby
secured, and the undersigned having been requested by the legal holder
of said indebtedness to foreclose said Deed of Trust, notice
is hereby given that I, as Substitute Trustee aforesaid, will, within
lawful hours, at the front door of the Marshall County Courthouse, in
the City of Holly Springs, Mississippi, on Monday, January 5, 2009
offer for sale and sell at public outcry to the highest bidder for
cash, the following described property, situated in the County of
Marshall, State of Mississippi, to wit:

This is the same land and property as
conveyed to Thomas Mark Shaw by Quitclaim Deed from Amanda Whaley Shaw
dated July 13, 2001 and recorded in Land Deed Book No. 319 at page 736
having been originally conveyed to Thomas Mark Shaw and Amanda Whaley
Shaw by warranty deed executed by Jeff W. Overton recorded in the
Office of the Chancery Clerk of Marshall County, Mississippi.
Source Deed: This is the same land and
property conveyed to Gayle P. Work by Warranty Deed executed by Thomas
Mark Shaw dated August 31, 2006 recorded in the office of the Chancery
Clerk in Land Deed Book No. 368 at page 269.

PUBLIC NOTICE
The Marshall County Planning Commission
will meet for their regularly scheduled meeting on Thursday, Jan. 8,
2009, at 2 p.m. in the Marshall County Zoning Office at 590 Old Highway
78-East, Holly Springs. The public is invited to attend.
The following requests will be on the
agenda:
ITEM 1: Richard Davis requests to be
allowed to place a second dwelling (singlewide mobile home) on his
property located at 15 Ridgefield Cove for temporary use (approximately
one year) while renovating his house. The property in question is Lot
34 of Ridgefield Acres Subdivision Phase II, contains 2.55 acres and is
zoned R-2. Tabled from the November 13, 2008 meeting.
ITEM 2: James (Mike) Meziere and Tammy
Marrs are requesting to be allowed to place a second dwelling (double
wide mobile home) on their property located at 945 Shinault Road. If
allowed, the mobile home will be for Tammy’s uncle. This
request is being made because she has to care for her uncle due to his
illness. The property in question is part of Reed and Bartley
Subdivision, contains approximately eight (8) acres and is zoned R-E.
ITEM 3: Eddie Archer is requesting to
be allowed to place singlewide mobile homes on his lots located in
Watson Corner Farms Subdivision. Watson Corner Farms Subdivision
consists of 30 lots and Mr. Archer owns all but five (5) lots. The
property in question is zoned R-1.
ITEM 4: Dave Gilcrease has the option
to purchase Lot 10 of Meadowbrook Farms Subdivision. He is requesting
to be allowed to subdivide the Lot and build a new home on the property
for himself and give the existing home to his daughter. The property in
question is located at 144 Bell Road, contains eight (8) acres and is
zoned R-1.
ITEM 5: Jack Holland at 3642 Laws Hill
Road is replacing his singlewide mobile home with a doublewide mobile
home. He is requesting to be allowed to keep his existing singlewide
mobile home on the property to be used for storage. The property in
question is zoned R-2.
ITEM 6: Mr. and Mrs. James (Pete)
Roberson want to be allowed to operate a flea market at their property
(Victoria Mini Storage’s) located 1100 Skating Rink Road. If
this request is allowed, the flea market will be open from 8 a.m. - 5
p.m., Thursdays - Saturdays. The property in question is zoned C-1
(Commercial).
ITEM 7: Dimaggio Nichols requests to be
allowed to place a 399 sq. ft. log cabin on his mother, Lucille
Nichols’ property located at 649 Tunstall Road. If allowed,
the cabin will be a permanent placement and will only be used during
vacations and other visits. the property in question contains three (3)
acres and is zoned R-2.
ITEM 8: Marshaundra Harmon requests to
be allowed to operate a recreational park for reunions, birthday
parties, receptions and private parties at her property located at 4930
Tate-Marshall Road. Events will be held toward the back of her property
at a structure located on the premises. The property in question is Lot
7 of Bet Farms Subdivision, contains approximately six (6) acres and is
zoned R-2.
ITEM 9: Mark D.Duvall is requesting to
be allowed to keep a storage container he has placed on his property
located at 2452 Musgray Road. The container cannot be seen from the
road or adjoining properties. If allowed, he is planning to build
around the container and completely enclose for a barn/shed. The
property in questions is Tract 2 of Arthur Taylor Estates, contains
15.48 acres and is zoned Agricultural.
