SUBSTITUTE TRUSTEE’S NOTICE
OF SALE
WHEREAS, on June 17, 2003, Beverly
Stanton, a single woman executed a deed of trust to First National
Financial Title, Trustee for the benefit of New Century Mortgage
Corporation, which deed of trust is recorded in Deed of Trust Book 331
at Page 492 in the office of the Chancery Clerk of the County of
Marshall, State of Mississippi; and
WHEREAS, the aforesaid deed of trust
was assigned to DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE UNDER
THE POOLING AND SERVICING AGREEMENT DATED AS OF SEPTEMBER 1, 2003,
MORGAN STANLEY ABS CAPITAL I INC. TRUST 2003-NC8, by instrument dated
September 24, 2008, and recorded as Instrument Number 2008005535 of the
records of the aforesaid Chancery Clerk; and
WHEREAS, the aforesaid, DEUTSCHE BANK
NATIONAL TRUST COMPANY, AS TRUSTEE UNDER THE POOLING AND SERVICING
AGREEMENT DATED AS OF SEPTEMBER 1, 2003, MORGAN STANLEY ABS CAPITAL I
INC. TRUST 2003-NC8, the holder of said deed of trust and the note
secured thereby, substituted James L. DeLoach as Trustee therein, as
authorized by the terms thereof, by instrument dated October 30, 2008
and recorded in the office of the aforesaid Chancery Clerk as
Instrument Number 2008006086; and
WHEREAS, default having been made in
the terms and conditions of said deed of trust and the entire debt
secured thereby, having been declared to be due and payable in
accordance with the terms of said deed of trust, and the legal holder
of said indebtedness, DEUTSCHE BANK NATIONAL TRUST COMPANY, AS TRUSTEE
UNDER THE POOLING AND SERVICING AGREEMENT DATED AS OF SEPTEMBER 1,
2003, MORGAN STANLEY ABS CAPITAL I INC. TRUST 2003-NC8, having
requested the undersigned Substitute Trustee to execute the trust and
sell said land and property in accordance with the terms of said deed
of trust for the purpose of raising the sums due thereunder, together
with attorney’s fees, Substitute Trustee’s fees and
expense of sale;
NOW, THEREFORE, I, James L. DeLoach,
Substitute Trustee in said deed of trust, will on December 18, 2008,
offer for sale at public outcry for cash to the highest bidder, and
sell within legal hours (being between the hours of 11:00 A.M. and 4:00
P.M.) at the front door of the Marshall County Courthouse in Holly
Springs, Marshall County, State of Mississippi, the following described
property situated in the County of Marshall, State of Mississippi,
to-wit;
LOT 1, INGRAM'S PLACE SUBDIVISION, PHASE 1, SECTION A, IN SECTION 26,
TOWNSHIP 2 SOUTH, RANGE 5 WEST, AS SHOWN ON PLAT OF RECORD IN PLAT BOOK

ORDINANCE AMENDING THE COMPREHENSIVE ZONING REGULATIONS FOR THE CITY OF
HOLLY SPRINGS, MISSISSIPPI, BY CHANGING THE CLASSIFICATION OF CERTAIN
REAL PROPERTY LOCATED IN THE CITY OF HOLLY SPRINGS, MISSISSIPPI, FROM
R-12 TO B-4
WHEREAS, it is found and determined by
the Mayor and Board of Aldermen of the City of Holly Springs,
Mississippi, that a change in the classification of certain real
property described herein, is necessary and advisable and in the best
interest of the municipality and its inhabitants, to change the zoning
classification for said property; and
WHEREAS, by previous ordinance,
amendments and changes were contemplated and allowed by giving at least
fifteen (15) days’ notice of a public hearing to consider any
change or amendment; and
WHEREAS, the City Board of Aldermen
did, on October 7, 2008, give notice of a public hearing to be held on
Wednesday, November 5, 2008, at the Board Room at City Hall, located at
160 South Memphis Street, Holly Springs, Mississippi, and
WHEREAS, notice of said public hearing
was published in The South Reporter, a newspaper having a general
circulation in the City of Holly Springs, Mississippi, on October 16,
2008, October 23, 2008, and October 30, 2008; and
WHEREAS, the property to be rezoned is
described as follows:

Beginning at a stake in the Southeast
Corner of Lot No. 206, on Section 6, Township 4, Range 2 West,
according to the plat and plan of the City of Holly Springs; running
North, following the West boundary line of Maury Street, 51 feet to a
stake; running thence West 59 feet to a stake; running thence South 51
feet to a stake; running thence East 59 feet to stake at the point of
beginning, and being in the Southeast part of Lot No. 206, on Section
6, Township 4, Range 2 West.
WHEREAS, no protest or opposition was received regarding the proposed
rezoning of said property from classification of R-12 to B-4.
THEREFORE, BE IT, AND IT IS HEREBY
ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF HOLLY
SPRINGS, MISSISSIPPI, AS FOLLOWS:
SECTION I. The recitals
contained in the preamble of this ordinance are hereby found and
declared to be true and correct, and the same are incorporated herein
by reference.
SECTION II. The zoning
classification of the real property described hereinabove, shall be
permanently amended and changed from the classification of R-12 to that
of B-4.
SECTION III. The property
described in this ordinance may be used in any manner provided for by
previous zoning ordinance consistent with the classification of B-4.
SECTION IV. The Clerk of the
City of Holly Springs is directed to publish a copy of this ordinance
in the local newspaper, The South Reporter, for one (1) week.
This ordinance shall be in full force and effect from thirty (30) days
after said publication.
The foregoing ordinance was introduced
and, upon motion by Alderman Liddy, duly seconded by Alderman Hutchens,
was discussed and considered, section by section, and then as a
whole. The motion was put to a roll call vote by the Mayor,
and the result was as follows:

All projects funded under the
Mississippi Water Pollution Control Revolving Loan Fund Program undergo
a review to determine whether the proposed project will have a
significant impact on the environment. In making this
determination, the Department assumes that all of the facilities and
actions recommended in the facilities plan will be
implemented. The facilities plan for this project is entitled
“Facilities Plan for Sewer System Improvements Cayce /
Highway 72 Area” dated July, 2008 and prepared by Elliott
& Britt Engineering, P.A.
The proposed project includes
approximately 3,200 L.F. of 6 inch force main, upgrades to existing
lift stations, new lift stations, approximately 21,900 L.F. of 8 inch
gravity sewer, approximately 63 manholes, service connections to
approximately 143 customers and related appurtenances. The
estimated project cost is $1,352,500, and the anticipated loan amount
is $452,500. The location of the proposed project is in the
area along and near Cayce Road and MS Highway 72.
The Mississippi Office of Pollution
Control has determined that the proposed project will not have a
significant adverse impact on the environment and consequently is
issuing this Finding of No Significant Impact. However, this
determination can be revoked if significant adverse information becomes
available. To review the facilities plan or submit comments regarding
