RESOLUTION TO AMEND THE COMPREHENSIVE
ZONING REGULATIONS
FOR THE CITY OF HOLLY SPRINGS,
MISSISSIPPI, BY AMENDING THE ZONING TO ALLOW DUPLEXES TO BE PERMITTED
ON APPEAL IN AN R10 ZONE
WHEREAS, the Mayor and Board of
Aldermen of the City of Holly Springs, Mississippi, do desire to amend
the Comprehensive Zoning Plan for the City of Holly Springs by amending
the zoning to allow duplexes to be permitted on appeal in an R10 zone;
WHEREAS, by previous ordinance, certain
amendments and changes were contemplated and allowed by giving at least
fifteen (15) days’ notice of a public hearing to consider any
proposed change or amendment;
WHEREAS, the City Board of Aldermen do
hereby give notice that a public hearing will be held on Tuesday, 3rd
day of June, 2008, at 5:30 P.M., at the Board Room at City Hall,
located at 160 South Memphis Street, Holly Springs, Mississippi;
NOW, THEREFORE, BE IT RESOLVED, that,
this Resolution is hereby adopted and shall be published once in The
South Reporter, a legal publication, the first publication being at
least fifteen (15) days prior to the public hearing noticed herein.

Resolution, seconded by Alderman Hayes.
The Resolution was put to a roll-call
vote by the Mayor, and the result was as follows:

WHEREAS, on July 27, 2006, David Yates
and wife, Jamie Yates, executed a deed of trust to Southern Trust Title
Company, trustee for the benefit of “MERS” Mortgage
Electronic Registration Systems, Inc., which deed of trust is recorded

Book 417 Page 106 in the office of the Chancery Clerk of the County of

INTERNATIONAL BUILDING CODE, THE INTERNATIONAL GAS CODE, THE
INTERNATIONAL HOUSING CODE, THE INTERNATIONAL MECHANICAL CODE, THE
INTERNATIONAL PLUMBING CODE, THE INTERNATIONAL FIRE CODE, THE
INTERNATIONAL UNSAFE BUILDING ABATEMENT CODE, THE NFPA LIFE SAFETY CODE
101, THE INTERNATIONAL ELECTRIC CODE, AND THE 2008 EDITION OF THE NFPA
NATIONAL ELECTRIC CODE
WHEREAS, the 2006 editions and any and
all supplements of the International Building Code, the International
Gas Code, the International Housing Code, the International Mechanical
Code, the International Plumbing Code, the International Fire Code, the
International Unsafe Building Abatement Code, the NFPA Life Safety Code
101, the International Electrical Code, and the 2008 Edition of the
NFPA National Electric Code, all printed in pamphlet form, having been

and all supplements of the International Building Code, the
International Gas Code, the International Housing Code, the
International Mechanical Code, the International Plumbing Code, the
International Fire Code, the International Unsafe Building Abatement
Code, the NFPA Life Safety Code 101, the International Electric Code,
and the 2008 Edition of the NFPA National Electric Code, as
aforementioned, are hereby adopted in their current form and edition as
Ordinance of the City of Holly Springs, Mississippi.
SECTION 3. Said Codes shall be
certified to by the Mayor and Clerk of the City of Holly Springs,
Mississippi, and shall be filed as a permanent record in the office of
said Clerk.
SECTION 4. To the extent that
any portion of any of the aforementioned Codes are in conflict, the
more restrictive code shall be followed.
SECTION 5. Notice of the adoption of
such codes shall be given by publication in The South Reporter, a
newspaper published in and having a general circulation in the City of
Holly Springs, Mississippi, for one time, such notice to be in
substantially the following form:
