Commission of Marshall County, Mississippi, hereby gives public notice
that a “Public Hearing” shall be held by the
Planning Commission on May 8, 2008 at 3:00 P.M. at the Marshall County
Zoning Office at 590 Old Highway 78 East in Holly Springs, Mississippi
and by the Board of Supervisors at 10:00 A.M. on Monday, May 19, 2008,
in the Board of Supervisors Room at 103B Market Street in Holly
Springs, Mississippi, concerning the intent to amend the Marshall
County Zoning Regulations to include the following:

Fireworks Stand Requirements
and Set-Up Procedures
Firework sales shall be allowed
only in
areas zoned commercial
and Industrial. Marshall County Industrial Authority must first approve
sales in the Chickasaw Industrial Park before Zoning will consider the
request.
Sales or other distribution of
fireworks shall be limited to
fireworks authorized under the laws of the State of Mississippi, with
the exception that the sale or other distribution of fireworks known as
bottle rockets is prohibited.
Verification of liability and
property
damage insurance policy
in the amount of $1,000,000 (1 million dollars), with a rider attached
designating the County as additionally assured thereunder.
Fireworks stands shall be located
at
least twenty-five (25)
feet from road or highway right-of-way, 100 feet from any adjoining
property owner and 25 feet from any structure.
Stands shall be located at least
100
feet from any storage or
use of flammable or combustible liquids.
Off street parking must be
provided for
employees and
customers.
Weeds and grass must be cut back
(mowed
close) within one
hundred (100) feet of the stand. The premises shall be maintained in a
clean, neat and orderly condition at all times and be free from any
condition that would create a “fire nuisance.”
Only one (1) 32 square foot (4 x
8)
advertising sign shall be
erected in the front of the stand and said sign shall be located off
all right-of-ways.
Verification that the tents are
fire
retardant (must be
labeled).
Vehicles used for sleeping
(trailers,
campers, etc.) shall be
at least 25 feet from any stand. No sleeping in fireworks stand.
All fireworks retail sales
locations
shall be under the direct
supervision of a responsible person who is at least eighteen (18) years
of age or older (there shall be at least one (1) adult in attendance at
all times during which fireworks are available for sale). Any
additional employees shall be at least sixteen (16) years of age or
older.
Bathroom facilities shall be
provided
for employees.
No shooting of fireworks shall be
permitted within one hundred
(100) feet of the fireworks stand.
Sales of fireworks shall not be
made to
any person under the
age of eighteen (18).
There shall be no matches,
lighters or
other open flame
devices stored, nor offered for sale in any fireworks stand.
For lighting and heating purposes
no
open flames shall be
allowed.
Each fireworks stand shall have
at
least two (2) fire
extinguishers and a cellular phone in case of emergencies. Fire
extinguishers shall bear a State Fire Marshal’s certification
tag that the extinguisher has been tested within the past 12 months.
Exits shall be at least 36 inches
in
width. Stands in excess
of twenty (20) feet in length must have at least two (2) exits and
stands in excess of forty feet must have at least three (3) exits.
There shall be exits on the front and back of the structure. Exits
shall be spaced approximately an equal distance apart but in no case
shall the distance between exits exceed twenty (20) feet. The aisles
within the stand shall be maintained free and clear of all obstructions
and shall be at least three (3) feet in width.
“NO SMOKING”
signs
shall be prominently
displayed in red lettering on the fireworks stand. No smoking shall be
allowed within 100 feet of the stand.
All applications for fireworks
stand
permits shall supply the
following information:
a. Applicant address and
telephone
number.
b. Statement from the property
owner
that the applicant can
sell fireworks from the property in question. Owner must include his
telephone number and address.
c. List of sales people at the
fireworks stand and
verification of ages.
d. Telephone number for the
fireworks
stand.
e. Drawing of the property
indicating
location of the stand
from the road or highway right-of-way. Show parking area for customers
with dimensions.
f. If a sign will be used to
advertise
show the location and
size.
Applicant must contact the
Marshall
County Zoning Office and
arrange a time for inspection prior to the sale of any fire works.
Zoning Fee: $150.00 per set-up.

construction of an ASPHALT APRON
EXPANSION, will be received by the Marshall County Industrial
Development Authority, hereinafter referred to as the OWNER, at 520 J.
M. Ash Drive, Holly Springs, MS 38635, until 2:00 P.M., local time, May

expansion of the asphalt apron
