WHEREAS, on January 14, 2004, Lucy Balfour executed a Deed of Trust to William F. Schneller as Trustee for the benefit of Mortgage Electronic Registration Systems, Inc. as Nominee for First Choice Funding, Inc., which Deed of Trust was recorded in Book 347, Page 89 in the Office of the Chancery Clerk of Marshall County, Mississippi; and

WHEREAS, Mortgage Electronic Registration Systems, Inc. as Nominee for First Choice Funding, Inc., the holder of said Deed of Trust and the Note secured thereby, substituted Scot P. Goldsholl as Trustee therein, as authorized by the terms thereof, as evidenced by an instrument dated January 10, 2006, and recorded in Book 402, Page 18 in the Office of the Chancery Clerk of Marshall County, Mississippi; and

REQUEST FOR PROPOSALS

The Marshall County Board of Supervisors will receive sealed proposals from qualified firms for professional services required in the preparation of their 2006 applications for Federal and State funded projects, including submission of applications for public facilities, economic development, planning and/or housing projects and submission of applications for state or federal funds from the Department of Housing and Urban Development, State of Mississippi for grants under HOME/HOPE/CDBG and all other similar federal/state programs.

Proposals are requested for the preparation of the applications and submissions of the same to all state and federal agencies and for administration of the projects upon funding. No fees will be paid for an unsuccessful application, for a successful application only such fees as are allowed and funded by the funding agency will be paid.

Proposals will be rated according to the following criteria: (1) qualifications - 5 points; (2) experience - 5 points; (3) performance capacity - 5 points; (4) and familiarity with the local area - 5 points.

Proposals are requested in accordance with 24 CFR Part 85 “Common Rule” and any other applicable state and federal rules and regulations. The Board reserves the right to reject any or all proposals, and to waive any irregularities in the proposal process.

Proposals should be sealed and labeled and may be delivered to the office of the Chancery Clerk on or before 9:00 a.m. on February 21, 2006. At this time the proposals will be opened and read aloud.

WHEREAS, on the 23rd day of January, 2006, the Holder of said Deed of Trust substituted and appointed Emily Kaye Courteau as Trustee in said Deed of Trust, by instrument recorded in the office of the aforesaid Chancery Clerk in Book 401 at Page 448; and

Run thence West with the North boundary of Park Avenue 122.0 feet; thence North 79.0 feet; thence East 122.0 feet to a point on the West boundary of Walthall Street; thence South with the West boundary of Walthall Street 79.0 feet to the point of beginning. Being the same property conveyed to the Grantors by deed of record at Book 211, Page 265 and Book 294, Page 28 in said Chancery Clerk's Office.

I will only convey such title as is vested in me as Substitute Trustee.

Under and by virtue of the authority vested in me as Substitute Trustee in that certain Deed of Trust dated June 17, 2002 executed by CHRIS W. STEWART and ROXANE C. STEWART, unto JENNIFER L. SHACKELFORD as Trustee, to secure an indebtedness therein described to Bank of Holly Springs, said Deed of Trust being of record in Land Deed of Trust Book 306 pages 414-420; Deed of Trust dated August 4, 2003 executed by CHRIS W. STEWART and ROXANE C. STEWART, unto JENNIFER L. SHACKELFORD as Trustee, to secure an indebtedness therein described to Bank of Holly Springs, said Deed of Trust being of record in Land Deed of Trust Book 335pages 287-293.

The undersigned was appointed as Substitute Trustee by instrument dated August 27, 2004 recorded in Land Deed of Trust Book 362 page 671; all in the records of the Clerk of the Chancery Court of Marshall County, Mississippi; and default having been made in the payment of the indebtedness thereby secured, and the undersigned having been requested by the legal holder of said indebtedness to foreclose said Deed of Trust, notice is hereby given that I, as Substitute Trustee aforesaid, will, within lawful hours, at the South front door of the Marshall County Courthouse, in the City of Holly Springs, Mississippi, on Friday, March 3, 2006 offer for sale and sell at public outcry to the highest bidder for cash, the following described property, situated in the County of Marshall, State of Mississippi, to wit:

SOURCE DEED: This is the same land and property as conveyed to CHRIS W. STEWART and wife ROXANE C. STEWART, jointly as an estate in the entirety with right of survivorship and not as tenants in common, by warranty Deed from Charles L. Stewart, dated March 22, 2002, and recorded in Land Deed Book 325, at page 423, in the office of the Chancery Clerk of Marshall County, Mississippi.

SUBJECT TO: Rights of way and easements for public road and utilities

The purchaser will be required to pay the full amount of his bid in cash at the time of the sale. I will sell and convey only such title as is vested in me as Substitute Trustee.
