NOTICE OF SUBSTITUTED TRUSTEE'S SALE
STATE OF MISSISSIPPI
COUNTY OF MARSHALL
WHEREAS, on June 10, 1998, Paul Bennett and Shirley Bennett executed a promissory note payable to the order of Amera Trend Mortgage, Inc.; and
WHEREAS, the aforesaid promissory note was secured by a Deed of Trust June 10, 1998, executed by Paul Bennett and Shirley Bennett, and being recorded in Book 237, at Page 843 of the records of the Chancery Clerk of Marshall County, Mississippi; and which aforesaid Instrument conveys to American Title Company, Inc., Trustee, the hereinafter described property; and
WHEREAS, said Deed of Trust was assigned to Novastar Mortgage, Inc. as evidenced by an Assignment and Transfer of Lien filed on May 10, 1999, and recorded in Book 59, at Page 195, in the records of the Chancery Clerk of Marshall County, Mississippi; and
WHEREAS, Novastar Mortgage, Inc. having executed a Substitution of Trustee to substitute Floyd Healy as trustee in the place and stead of American Title Company, Inc. the same having been recorded in Book 417, at Page 372, of the records of the Chancery Clerk of Marshall County, Mississippi; and
WHEREAS, default having occurred under the terms and conditions of said promissory note and Deed of Trust and the holder having declared the entire balance due and payable; and
WHEREAS, Floyd Healy, Substituted Trustee in said Deed of Trust will on the 22nd day of September, 2006, between the hours of 11:00 a.m. and 4:00 p.m., offer for sale and will sell at public outcry to the highest bidder for cash at the south front of the Marshall County Courthouse in Holly Springs, Mississippi, the following described property located and situated in Marshall County, Mississippi, to wit:
Land situated in Marshall County, Mississippi and more particularly described as follows:
Lot No. 5 of the W. F. Moore Subdivision of Section 23, Township 2 South, Range 5 West, according to plat of said subdivision recorded in Plat File No. 236B of the records of the Clerk of the Chancery Court of Marshall County, MS, containing 3.3 acres, more or less.
Being the same property conveyed to Paul Bennett by deed from Cherria J. Boyle, of record in Book 285, Page 371, Register's Office for Marshall County, Mississippi.
More commonly known as: 779 Highway 309 North, Byhalia, Mississippi 39611
Subject to the rights of way and easement for public roads and public utilities, and to any prior conveyance or reservation of mineral of every kind and character, including but not limited to oil, gas, sand and gravel in or under subject property.
As the undersigned Substituted Trustee, I will convey only such title as is vested in me under said Deed of Trust.

WHEREAS, on the 31st day of December, 2003, Eugene P. Fuller, a married person and Sharron W. Fuller, his wife, executed and delivered a certain Deed of Trust unto D.M. Grisham, Trustee for National Bank of Commerce, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Marshall County, Mississippi in Book 346 at Page 1; and
WHEREAS, by various assignments on record said Deed of Trust was ultimately assigned to Bank of New York as Trustee for the Certificate Holders of CWABS 2004-03 by instrument recorded in the office of the aforesaid Chancery Clerk in Book 91 at Page 298; and
WHEREAS, on the 4th day of August, 2006, the Holder of said Deed of Trust substituted and appointed Emily Kaye Courteau as Trustee in said Deed of Trust, by instrument recorded in the office of the aforesaid Chancery Clerk in Book 417 at Page 242; and

Said Tract containing 2.38 acres more or less (103,785 Square Feet).
