You have been made a Defendant in the suit filed in this Court by Donald M. Bridges, Plaintiff, seeking to set aside deed and confirm title to certain real property.

You are required to mail or hand deliver a written response to the Complaint filed against you in this action to J. Kizer Jones, Attorney At Law, the attorney for the Plaintiff, whose address is Post Office Box 117, Holly Springs, Mississippi, 38635.

Your response must be mailed or delivered not later than (30) thirty days after the 19th day of January, 2006, which is the date of first publication of this summons. If your response is not so mailed or delivered, a judgment by default will be entered against you for the money or other relief demanded in the Petition.

You must also file the original of your response with the Clerk of this Court within a reasonable time afterward.

SUBSTITUTED TRUSTEE’S NOTICE OF SALE

WHEREAS, on March 8, 2005, John M. Cross and Linda (G.) Cross, executed a deed of trust to Atty. Arnold M. Weiss, trustee for the benefit of "MERS" Mortgage Electronic Registration Systems, Inc., which deed of trust is recorded in Deed of Trust Book 377 at Page 420 in the office of the Chancery Clerk of the County of Marshall, State of Mississippi; and

WHEREAS, the aforesaid, "MERS" Mortgage Electronic Registration Systems, Inc., the holder of said deed of trust and the note secured thereby, substituted John C. Underwood, Jr., as Trustee therein, as authorized by the terms thereof, by instrument dated November 16, 2005 and recorded in the office of the aforesaid Chancery Clerk in Book 397 at Page 495; and

WHEREAS, default having been made in the terms and conditions of said deed of trust and the entire debt secured thereby, having been declared to be due and payable in accordance with the terms of said deed of trust, and the legal holder of said indebtedness, "MERS" Mortgage Electronic Registration Systems, Inc., having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said deed of trust for the purpose of raising the sums due thereunder, together with attorney’s fees, Substituted Trustee’s fees and expense of sale;

Turner property (Deed Book 81, Page 48), 535.32 feet to an iron rod set on the North right-of-way of Railroad Avenue, said point being 70 feet North of and perpendicular to the center-line of the railroad; thence, run North 73 degrees 21 minutes West, 105.00 feet to an iron rod set; thence, run North 00 degrees 46 minutes West, along a fence, 503.22 feet to a cross tie fence corner; thence, run North 88 degrees 56 minutes East, 110.61 feet to the Point of Beginning.

Together with all buildings, hereditaments and appurtenances thereunto belonging.

This is a part of the same land and property conveyed to Baxter H. Turnage, Jr., by Special Warranty Deed dated June 11, 1990, found and recorded in Land Deed Book 232, at Page 723. Also, being the same property conveyed to Debra L. Placker, by virtue of Warranty Deed dated November 11, 1993, found and recorded in Land Deed Book 255, at Page 621.

SUBJECT TO: Rights of way and easements for public roads and utilities. Easement for driveway purposes recorded in Land Deed Book 200, at Page 675, in the Office of the Chancery Clerk of Marshall County, Mississippi.

SUBJECT TO: Laws, ordinances and regulations which govern the use and occupancy of this land enacted by the United State of America, the State of Mississippi and its political subdivisions and particularly including the subdivision regulations and zoning ordinances adopted by ordinances of the Board of Supervisors of Marshall County, Mississippi, none of which render title unmarketable.

LEGAL NOTICE

The City of Holly Springs is requesting Statements of Qualifications from qualified professional engineering firms to prepare plans and specifications for a Public Facility in connection with a Community Development Block Grant (CDBG) for FY 2006. In addition to plans and specifications, engineering services are needed to prepare preliminary and final design(s), prepare bid documents, and provide site inspections during project construction. Those desiring consideration must prepare and submit a Statement of Qualification that addresses all the following evaluation criteria:

Experience and technical expertise – (20 Points)

Ability to successfully design and oversee CDBG projects – (20 Points)

Availability of qualified personnel – (20 Points)

Record of success on similar projects – (20 Points)

Schedule of time to complete project(s) – (20 Points)

Proposals shall be reviewed using the above criteria and point factors. Contract negotiations shall be initiated with the qualified engineering firm whose proposal is determined to be most advantageous to the City of Holly Springs, based on the evaluation criteria. The City of Holly Springs reserves the right to negotiate with more than one qualified engineering firm and also to cancel all proceedings and begin a new process of soliciting proposals. In order to be considered, qualified proposals must be received by 4:00 p.m. on 1/31/2006. Proposals must be addressed to the City of Holly Springs, 160 South Memphis Street, Holly Springs, MS 38635 and marked on the outside as "Proposal for Engineering Services – FY 2006 CDBG". Information concerning the proposals may be obtained from the above address or by calling 662-252-9976.
