NOTICE OF TRUSTEE'S SALE OF LAND

Under and by virtue of the authority vested in me as Trustee in that certain Deed of Trust dated March 16, 2000, executed by VIRGINIA CULVER AKA VIRGINIA CAROL CULVER HATFIELD AND DONALD HATFIELD, unto WILLIAM F. SCHNELLER as Trustee, to secure an indebtedness therein described to First State Bank, said Deed of Trust being of record in Land Deed of Trust Book 263 pages 321-326; Deed of Trust dated June 16, 2004, executed by CAROL HATFIELD AKA VIRGINIA CULVER AND DONALD HATFIELD, unto WILLIAM F. 80 acres of land lying and being situated on the north part of a 120 acre tract of land, which lies East of the Illinois Central Railroad, and being in the Northeast part of the Southwest Quarter of Section 7, Township 5, Range 2 West, Marshall County, Mississippi.

This being the same tract of property transferred by Warranty Deed from M. V. Young, et al to Rufus Smith, as recorded in Book 76 at page 384, in the Land Records in the Chancery Clerk’s Office of Marshall County, Mississippi. This also being the same property struck off to the State of Mississippi for unpaid property taxes on March 25, 1993, described as Northeast part Southwest Quarter, PPIN 3747.

SOURCE DEED: This is the same land and property as conveyed to Virginia Culver by Forfeited Tax Land Patent, State of Mississippi, dated November 5, 1993, and executed by Dick Molpus, Secretary of State, recorded on November 19, 1993 at 9:31 a.m., in Land Deed Book No. 255, Page 753, in the Office of the Chancery Clerk of Marshall County, Mississippi.

SUBJECT TO: A PORTION OF THE ABOVE PROPERTY IS SUBJECT TO A LIFE ESTATE CONVEYED TO GLADYS B. SMITH, described as:

A tract of land in the Southwest Quarter of Section 7, Township 5 South, Range 2 West, Marshall County, Mississippi, described as beginning at the Northwest Corner of the Southwest Quarter; thence West 884 feet to a point on the East side on Rail Road, Also being the Northwest corner of Carol Culver Property; thence

East along North line 300 feet; thence South 200 feet; thence West 300 feet; thence North along Rail Road right of way 200 feet to POINT OF BEGINNING, containing 1.4 acres, more or less.

SOURCE DEED: This is the same land and property as conveyed to Gladys B. Smith, for lifetime, by Warranty Deed, dated May 15, 1996, and executed by Virginia Carroll Culver, recorded on May 15, 1996 at 8:57 a.m., in Land Deed Book No. 273, Page 816, in the Office of the Chancery Clerk of Marshall County, Mississippi.

NOTE: the 1.4 acres should be LESS AND EXCEPTED FROM THE Bank’s Deed of Trust.

SUBJECT TO: Laws, ordinances and regulations which govern the use and occupancy of this land enacted by the United States of America, the State of Mississippi and its political subdivisions, and particularly including the subdivision regulations and zoning ordinances adopted by ordinances of the Board of Supervisors of Marshall County, Mississippi, none of which render title unmarketable.

The purchaser will be required to pay the full amount of his bid in cash at the time of the sale. I will sell and convey only such title as is vested in me as Trustee.

SUBSTITUTED TRUSTEE’S NOTICE OF SALE

WHEREAS, on February 5, 2000, Jimmy Lee Donnell and wife, Dorothy Donnell, executed a deed of trust to Robert Frappier, trustee for the benefit of Emmco the Mortgage Service Station Inc., which deed of trust is recorded in Deed of Trust Book 261 at Page 837 in the office of the Chancery Clerk of the County of Marshall, State of Mississippi; and

WHEREAS, the aforesaid deed of trust was assigned to HomeGold, Inc., S/B/M Homesense Financial Corporation by instrument dated July 31, 2003, and recorded in the office of the aforesaid Chancery Clerk in Book 78 at Page 754; and

WHEREAS, the aforesaid deed of trust was assigned to Bank One, National Association, as Trustee by instrument dated July 31, 2003, and recorded in the office of the aforesaid Chancery Clerk in Book 78 at Page 756; and

WHEREAS, the aforesaid, Bank One, National Association, as Trustee, the holder of said deed of trust and the note secured thereby, substituted John C. Underwood, Jr., as Trustee therein, as authorized by the terms thereof, by instrument dated February 3, 2004 and recorded in the office of the aforesaid Chancery Clerk in Book 348 at Page 352; and
