SUBSTITUTE TRUSTEE’S SALE OF LAND
Under and by
virtue of the authority vested in me as Substitute
Trustee in that certain Deed of Trust dated August 5,
1996 executed by Kirkwood National, LLC to David J.
Burge, Trustee to secure an indebtedness therein
described to NationsCredit Commercial Corporation, said
Deed of Trust being of record in Land Deed of Trust Book
213, pages 292-342: the undersigned being appointed as
Substitute Trustee by instrument dated September 26, 2003
recorded in Land Deed of Trust Book 339 pages 337-338 in
the Land Records of the Clerk of the Chancery Court of
Marshall County, Mississippi;
By
Assignment and Assumption of Deed of Trust dated March 3,
2000, and re-corded in the office of the Chancery Clerk
of Marshall County, Mississippi, in Power Of Attorney
Book No. 64, at pages 14-51, this Deed Of Trust was
assigned to Bank of America Commercial Finance
Corporation (formerly known as NationsCredit Commercial
Corporation), a Delaware corporation, executed by James
H. Kaufman, Sr. Vice President of Bank of America
Commercial Finance Corp. Said Assignment is amended by
First Amendment to Assignment of Leases and Rents dated
July 31, 2000, and recorded in the office of the Chancery
Clerk of Marshall County, Mississippi, in Power Of
Attorney Book No. 65, at page 93-125, this First
Amendment was executed by Kirkwood National Holding, LLC;
and Christopher P. Henry, Vice President of Bank of
America Commercial Finance Corp. Said Assignment is
amended by a Second Amendment to Assignment of Leases and
Rents dated August 10, 2000 and recorded in the office of
the Chancery Clerk of Marshall County, Mississippi in
Power of Attorney Book No. 65 at pages 235-266, second
amendment is executed by Kirkwood National Holding, LLC;
and Christopher P. Henry, Vice President of Bank of
America Commercial Finance Corp.

Assignment of Deed of Trust dated September 24, 2003, and
recorded in the office of the Chancery Clerk of Marshall
County, Mississippi, in Power Of Attorney Book No. 79, at
page 370-372, this Deed Of Trust was assigned to B, G, J
& H Partners, a partnership organized under the laws
of the State of Mississippi, whose address is Post Office
Box 250, 114-A South Memphis Street, Holly Springs,
Mississippi 38635, said assignment was executed by Bank
of American Commercial Finance Corporation; and by virtue
of the Authority vested in me a Trustee in that certain
Deed of Trust dated September 26, 2003, in renewal and
extension of the aforesaid, executed by Greg Barkley,
Manager of Kirkwood National Holding, LLC, to William F.
Schneller, as Trustee, to secure an indebtedness therein
described to BGJ&H Partners, said Deed of Trust being
of record in Land Deed of Trust Book 340, pages 279-316;
and default having been made in the payment of the
indebtedness thereby secured, and the undersigned having
been requested by the legal holder of said indebtedness
to foreclose said Deed of Trust, notice is hereby given
