WHEREAS, on the 12th day of December, 2002, the Holder of said Deed of Trust substituted and appointed John C. Morris, III, as Trustee in said Deed of Trust, by instrument recorded in the office of the aforesaid Chancery Clerk in Book 317 at Page 280; and

WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 9th day of November, 2005, I will during legal hours, at public outcry, offer for sale and will sell, at the South Door of the Marshall County Courthouse at Holly Springs, Mississippi, for cash to the highest bidder, the following described land and property situated in Marshall County, Mississippi, to-wit:

LEGAL NOTICE

The Marshall County Board of Supervisors is requesting Statements of Qualifications from qualified organizations to provide consulting services in preparing and administering the Countyís Community Development Block Grants (CDBG). The services shall include preparing CDBG project applications and administering the CDBG projects upon funding. Those desiring consideration must prepare and submit a Statement of Qualification that addresses all of the following evaluation criteria:

 

Experience and success in preparing CDBG applications - (25 points)

Experience and success in administering CDBG projects - (25 points)

Qualifications of staff member(s) assigned to projects - (20 points)

Scope of services to carry out projects - (20 points)

Schedule of time to complete projects - (10 points)

 

Proposals shall be reviewed using the above criteria and point factors. Contract negotiations shall be initiated with the qualified organization whose proposal is determined to be most advantageous to the County, based on the above criteria. The Board of Supervisors reserves the right to negotiate with more than one qualified organization and also to cancel all proceedings and begin a new process of soliciting proposals. In order to be considered qualified proposals must be received by 2:00 p.m., October 27, 2005. Proposals must be addressed to the Marshall County Board of Supervisors, P.O. A segment of Nonconnah Creek in Marshall County is on the State of Mississippiís 2004 List of Impaired Water Bodies. Waters on this list are required to have Total Maximum Daily Loads (TMDLs) completed for each pollutant added to the water that causes impairment. A TMDL is the maximum amount of a pollutant that a stream can handle without violating water quality standards. A study has been completed allowing the determination of a TMDL for total biochemical oxygen demand (TBOD) in Nonconnah Creek. TBOD is a representation of the amount of organic pollution in a stream, which can lower the dissolved oxygen level.

The TMDL report that details the study of Nonconnah Creek has been completed by MDEQ. Prior to proposing this TMDL to the Environmental Protection Agency for approval, MDEQ is asking for public comment on this draft document. Copies of the draft TMDL may be obtained and/or inspected by contacting Debbie Pridgen at the above address and telephone number or by email (Debbie_Pridgen@deq.state.ms.us). Persons wishing to comment upon the draft TMDL are invited to submit comments in writing to Mr. Greg Jackson at the address shown above or by email (Greg_Jackson@deq.state.ms.us) no later than 5:00 p.m. on November 11, 2005. FISCAL YEAR 2005-2006 INCLUDING ROAD DISTRICT AND ANY OTHER TAXING DISTRICTS

There came on for hearing and consideration by the Board of Supervisors of Marshall County on this the 12th day of September, 2005, the matter of levying the ad valorem taxes for the fiscal year 2005 - 2006 on assessments of property as of January 1, 2005, for the County, the Road District, the School District, and for all other taxing districts, and fixing the tax rate of levy for the county and the districts, as stated in accordance with the provisions of Section 27-39-217, Mississippi Code of 1972, and other laws relative to said matter; and the Board having fully considered the needs and requirements of the various funds of the county and of the districts and the rates of levying which are required to produce the revenue necessary to meet the budget as made fixed and heretofore approved by this Board as required by law and it having been ascertained that the maintenance levy for the county wide school district is supported by proper and necessary petition as required by law; and it appearing that the tax rate of levies for the county wide and several county purposes, the road district, the school district, and other taxing districts are necessary in order to raise the funds required to meet the expenses of the county, and of said taxing districts for said fiscal year.

 

IT IS THEREFORE, ORDERED AND ADJUDGED BY THE BOARD OF SUPERVISORS OF MARSHALL COUNTY, MISSISSIPPI that the following ad valorem tax rates or levies be and the same are hereby imposed and levied for the fiscal year 2005-2006 upon the assessed value of all taxable property in Marshall County, State of Mississippi, and in respective road districts, school districts, and all other taxing districts in Marshall County as the property is now assessed and listed or as may hereinafter be assessed and listed upon the assessment rolls of said county as of January 1, 2005 (except the exempt assessed values of homes to be exempt by ëThe Homestead Exemption Act of 1946í), and said expressed rates in mills or in decimal fraction of a mill being levied and imposed upon each dollar of assessed valuation appearing upon the assessment rolls of said County as aforesaid for the following funds or purposes; and, when the money is collected it shall be credited to the respective funds as provided by law.

It is further ordered by the Board of Supervisors that all ad valorem taxes levied and empowered are fixed within the limits as stated in Chapter 30, Title 27 of the Mississippi Code of 1972, as amended, the general county taxes being governed by Section 27-39-317, Mississippi Code of 1972, and the school district taxes by Title 37 of the Mississippi Code of 1972, as amended.

 

SECTION 7. It is further ordered that all monies received and collected by the Tax Assessor and Collector and paid by him to the proper fund according to the provision of the order shall be credited to the designated fund by the County Auditor, in accord with the budget as heretofore adopted by this Board, and shall be expended in the manner and for the purpose set forth in said budget and for no other reason.

 

SECTION 8. The Marshall County Board of Supervisors is requesting Statements of Qualifications from qualified professional engineering firms in preparing plans and specifications for the Countyís Community Development Block Grants (CDBG). In addition to plans and specifications, engineering services are needed to prepare preliminary and final design(s), prepare bid documents, and provide site inspections during project construction. Those desiring consideration must prepare and submit a Statement of Qualifications that addresses all the following evaluation criteria:

 

Experience and technical expertise - (20 points)

Ability to successfully design and oversee CDBG projects - (25 points)

Availability of qualified personnel - (25 points)

Record of success on public improvement projects - (20 points)

Schedule of time to complete projects - (10 points)

 

Proposals shall be reviewed using the above criteria and point factors. Contract negotiations shall be initiated with the qualified engineering firm whose proposal is determined to be the most advantageous to the County, based on the above criteria. The Board of Supervisors reserves the right to negotiate with more than one qualified engineering firm and also to cancel all proceedings and begin a new process of soliciting proposals. In order to be considered qualified proposals must be received by 2:00 p.m., October 27, 2005. Proposals must be addressed to the Marshall County Board of Supervisors, P.O.
