NOTICE

The Holly Springs Housing Authority will hold a public meeting to obtain comments on its FY 2005 Public Housing Authority Agency Plan to be presented to the Department of Housing and Urban Development.

Said hearing will be held at 12:00 p.m. on Tuesday, March 15, 2005 at the Housing Authority Central Office, 700 Hwy 4 East, Holly Springs, Mississippi.

The Housing Authority Agency Plan identifies basic goals and strategies over a five year period as required by HUD Quality Housing and Work Responsibility Act of 1998. REQUEST FOR RELEASE OF FUNDS

On or about February 15, 2005, the City of Holly Springs, Marshall County will request the Department of Housing and Urban Development to release the Economic Development Initiative Grant Funds approved by Congressional Special Appropriation. To undertake a project known as North Memphis Street Redevelopment & Revitalization Project. The goal and vision of the project will be North Memphis Street Revitalization and Redevelopment, Acquisition of Properties, and Martin Street infrastructure and overlay of the area.

FINDING OF NO SIGNIFICANT IMPACT

The City of Holly Springs has determined that the project will have no significant on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Holly Springs, 160 South Memphis Street, Holly Springs, Mississippi 38635, and is available for review and may be examined or copied weekdays 8:00 a.m. and 5:00 p.m.

PUBLIC COMMENTS

Any individual, groups, or agency disagreeing with the determination or wishing to comment on the project may submit written comments to the City of Holly Springs, Community Development Program, 160 South Memphis Street, Holly Springs, Mississippi 38635. All comments received on or before February 15, 2005 will be considered by the City of Holly Springs prior to authorizing submission of a request for release.

RELEASE OF FUNDS

The City of Holly Springs certifies to the Department of Housing and Urban Development that Mr. Andre’ DeBerry in the capacity as Mayor consents to accept the jurisdiction of Federal Courts if an action is brought to enforce responsibilities in relations to the environmental review process and that these responsibilities have been satisfied. The Department of Housing and Urban Development approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the City of Holly Springs to use Program Funds, after funds are released.

OBJECTIVES OF RELEASE OF FUNDS

The Department of Housing and Urban Development will accept objections to its release of funds and the City of Holly Springs Certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following base:

a.) the certification was not executed by the Certifying of the City of Holly Springs

b.) the City of Holly Springs has omitted a step or failed to make a decision or finding required by HUD Regulation at 24CFR Part 58:

c.) the grant recipient has committed funds or incurred cost not authorized by 24 CFR Part 58 before approval of a release of funds by HUD: or

d.) another Federal Agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that project is unsatisfactory from the standpoint of Environment Quality. Objection must be prepared and submitted in accordance with the required procedures (24 CFR) and shall be addressed to U.S. Department of Housing and Urban Development, Environmental Protection Specialist, Mrs. Linda Poyhress, Environment Division, 40 Marietta Street, Atlanta, GA 30303.

No objections received after March 04, 2005 will be considered by Housing and Urban Development.

The Marshall County Planning Commission will meet for their regularly scheduled meeting on Thursday, February 10, 2005, at 2:00 p.m. in the Zoning Office at 590 Old Highway 78-East, Holly Springs, Mississippi. The public is invited to attend.

Said Ingress-Egress Easement containing 0.50 acres more or less.

SUBSTITUTED TRUSTEE'S NOTICE OF SALE

WHEREAS, on October 29, 2001, WEST PROPERTIES, LLC, executed a Deed of Trust to William F. Schneller, Trustee, for the benefit of First State Bank, which Deed of Trust is filed for record in Deed of Trust Book 291, at Pages 380-382, in the office of the Chancery Clerk of Marshall County, Mississippi; and

WHEREAS, said Deed of Trust authorized the appointment and substitution of another Trustee in the place of the Trustee named in said Deed of Trust or subsequently substituted therein, and First State Bank, appointed and substituted J. Kizer Jones as Trustee therein, by instrument dated December 30, 2004, and duly filed for record January 11, 2005, at 4:00 P.M. in the office of the aforesaid Chancery Clerk in Book 372, at pages 802-803; and

The land and property herein conveyed is further shown, described and depicted upon that certain plat and survey of Donald Jeff Hollingsworth, dated October 8, 2001.

TRUSTEE’S LAND SALE NOTICE

On March 18, 2004 , RANDY WILSON and CINDY WILSON, executed a Purchase Money Deed of Trust, recorded in Marshall County, Holly Springs, Mississippi land records, Land Trust Deed Book 358, Page 65 conveying hereinafter described land to Lynda M. Davis, Trustee, securing their note to BLM, LLC, Oliver M. Burch IV, Manager.

Debtor defaulted and legal holder accelerated the note and requested foreclosure.

As Trustee, in lawful hours, at the South door of Marshall County, Mississippi Courthouse on February 23, 2005, I will sell to highest cash bidder at public outcry the following land in Marshall County, Mississippi.

Lot number 111 of Cooper Road Farms, (Phase II), containing 5.93 acres, located in Section 22, Township 3 South, Range 5 West, Marshall County, Mississippi. A plat of said Cooper Road Farms is recorded in the land records of said County in Plat File 1005-A.

Purchaser shall pay his bid in cash at sale. I will convey only my title as Trustee.
