NOTICE OF PUBLIC HEARING

The Marshall County Planning Commission will hold a public hearing during their regular scheduled meeting on Thursday, September 8, 2005, at the Marshall County Zoning and Planning Office at 590 Highway 178 East, Holly Springs, Mississippi. The Commission will hear a rezoning request from Lamsal LLC., to rezone property from R-E to C-2 and R-e to I-1. The Commission will make a recommendation to the Marshall County Board of Supervisors in regard to rezoning (the decision to rezone is a decision that is made by the Marshall County Board of Supervisors). The public is cordially invited. Any person may appear before the Commission either in person or by agent, or may file written comments regarding the request with the Administrative Official prior to the hearing. Written comments should be submitted no later than September 7, 2005 (P.O. Box 219, Holly Springs, MS 38635). The Planning Commission meeting is at 2:00 P.M. and the rezoning hearing will be at 3:00 P.M.

Marshall Utility Services, LLC, has applied to the Mississippi Department of Environmental Quality for the issuance of Water-NPDES Permit No. MS0060046 for its proposed Chickasaw Trail Wastewater Treatment Plant to be located in North Marshall County off Dogwood Road. An anti-degradation review has been performed for this proposed discharge. The applicant's operations fall within SIC Code 4952, sewerage systems.

The applicant's operation is the collection and treatment of domestic wastewater. The proposed discharge location is Nonconnah Creek thence to the Coldwater River.

The staff of the Permit Board has developed this draft permit based on information submitted to the Permit Board by the applicant, appropriate State and Federal agencies and other interested parties. The staff of the Permit Board is soliciting all relative information pertaining to the proposed activity, including public comment, to ensure that the final staff recommendation on the draft permit complies with all State and Federal regulations. Public review and comment on the draft permit and supporting documentation is an important element in the staff evaluation and resulting recommendation to the Permit Board. The draft permit conditions have been developed to ensure compliance with all State and Federal regulations but are subject to change based on information received as a result of public participation.

Persons wishing to comment upon or object to the proposed determinations are invited to submit comments in writing to Greg Burgess at the Permit Board's address shown above, no later than September 17, 2005. PUBLIC NOTICE

The Board of Supervisors of Marshall County, Mississippi, hereby gives public notice that a "Public Hearing" shall be at September 6, 2005 at 10:00 A.M. 2005, on Amending the Marshall County Zoning Ordinance in the Board of Supervisors Room at 103B Market Street in Holly Springs, Mississippi, concerning the intent to amend the Marshall County Zoning Regulations- - Article 111-District Regulations and Article IV-General Provisions as follows:

Section — 3 — RE-Residential Estate District -- - Permitted Uses:

A-2. Single-family dwellings containing not less than 1,200 square feet of heated area and accessory buildings amended to include:

single-family dwellings shall have a attached garage not less than 400 (20 x 20) square feet that opens to the side or rear of the house. There shall be a minimum of exterior masonry (brick or stone) on the front of the home that extends to the bottom ledge of the windows.

Section - 3B- - Uses Permitted by Special Exception:

Amended to include: Two (2) family dwellings and multi-family dwellings in areas with community water and sewer with a recommendation by the Planning Commission and with approval by the Board of Supervisors

Section 4 — R-1 Residential (Low Density) District B.

Uses Permitted by Special Exception: 4. Single-wide mobile homes: Amended to include - provided that proof of medical hardship or extreme financial hardship (example: house burning) exists and shall be for a temporary period of time of one (1) year

Section 5- R-2---Residential (Medium Density) District Permitted Uses: A-2.-Single and two-family dwellings-- amended to delete two-family dwellings

Section —8— C-2 — Highway Commercial District --- Permitted Uses: A-3. Mobile home used as office space shall be deleted.

A-8. Permitted Use: Mobile (Modular) homes sales, service repair and storage facilities for RV’s, camping trailers and touring vans— but not including a mobile home park or trailer park and not allowing storage of damaged mobile homes be amended to be a use permitted by special exception with recommendation from the Planning Commission and approval by the Board of Supervisors.

Section — 13- Chart of Regulations Shall be amended to include- - ****R..E — Residential Estate- - - Areas supplied by community water and sewer systems may have a lot area of one (1) acre if approved by the Board of Supervisors.

Article IV- - General Provisions

Amended to include Section 23 — Travel trailers and RV’s shall be parked at the back of the residence and be properly tagged. Structures that have been built prior to this ordinance for the housing of travel trailers and RV’s that are located to the side of a residence or in front will be grandfathered in, if neat in appearance. Travel trailers and RV’s are not for permanent residence. Temporary occupancy can be allowed with a special exception but only for a period of six (6) months for building of a home or a verified medical or financial hardship (example: house burning) exists and with an approved septic system located on the property for hook-up.
