SUBSTITUTE TRUSTEE’S LAND SALE NOTICE

On November 15, 1985, Leroy Beason and wife, Mattie P. Beason, executed a Purchase Money Deed of Trust, recorded in the land records of Marshall County, Mississippi land records, Land Trust Deed Book 137, pages 885, conveying hereinafter described land to Frances M. Gresham, Trustee, securing their note to Landman, Inc., a Mississippi Corporation.

Debtor defaulted and legal holder accelerated the note and requested foreclosure.

Said Frances M. Gresham, Trustee declined to act as trustee and the undersigned Lynda M. Davis was appointed trustee by instrument dated June 13, 2005, and recorded in the land records of said County in Book 383, page 880.

As Substitute Trustee in lawful hours at the South door of Marshall County, Mississippi Courthouse on July 18, 2005 I will sell to highest cash bidder at public outcry, the following land in Marshall County, Mississippi.

Tract number 111 of Hillfield Farms Subdivision, containing 4.06 Acres, being in Section 3, Township 2, South, Range 4 West, Marshall County, Mississippi. A plat of said subdivision being of record in the office of the Chancery Clerk of said County in Plat Files 722 A and B.

Purchaser shall pay his bid in cash at sale. I will convey only my title as Trustee.

The Marshall County Planning Commission will meet for their regularly scheduled meeting on Thursday, July 14, 2005, at 2:00 p.m. in the Zoning Office at 590 Old Highway 78-East, Holly Springs, Mississippi.

The public is invited to attend.

The following requests will be on the agenda:

ITEM 1: Mrs. Mary Lumley at 89 Lake Hill Cove is requesting the Marshall County Planning Commission to allow her to place a second residence (new double wide mobile home) on her property of 3.5 acres. If the request is allowed, Mrs. Lumley will move into the new double wide and her daughter and her daughter’s three (3) sons will live in the existing single wide mobile home. This request is being made because Mrs. Lumley is very sick and she needs her daughter close by so she and her sons can help her. The property in question is Lot #6 of Collierville East Farms Subdivision and zoned R-2.

ITEM 2: On August 9, 2001, Mr. and Mrs. James Holden had requested the Marshall County Planning Commission to allow them to build a home on the P.L. Lott property (266 Embry Road) due to the health of Mr. and Mrs. Lott. However the Lott’s health improved and they did not follow through. Mr. Lott has since died and Mrs. Lott’s health has deteriorated. The Holden’s are now requesting to build a home to see after Mrs. Lott. The property in question is zoned R-2.

ITEM 3: Mrs. Brittney Mosley requests to be allowed to place a single wide mobile home on her father’s (Timothy Brewer) property located on Gardner Road. If allowed, the mobile home will not be seen from the road. The property in question contains approximately 4.3 acres and is zoned Agricultural-Residential.

ITEM 4: Mrs. Lee A. Carver at 71 Pheasant Cove requests to be allowed to use a 8x40 storage container on her property as a storage building. The property in question is Lot #54 of Cayce Lakes Farms Subdivision and zoned R-1. If the request is allowed, Mrs. Carver stated she wants to paint, level and add a canopy.

ITEM 5: Mr. and Mrs. Kenneth Guffey at 582 Memphis Street are requesting the Marshall County Planning Commission to allow them to enlarge and remodel the existing storage building situated in their back yard as a residence for Mrs. Guffey’s mother. This request is being made because Mrs. Guffey’s mother is in bad health and needs to be where they can care for her. If the request is allowed, the building will have sleeping accommodation, bath and a small kitchen without a stove. The property in question is Lot #16 of Mt. Pleasant Valley Estates Subdivision and zoned R-E.

ITEM 6: Mr. Ronald E. Maxwell has purchased property at 5065 Cayce Road (aka Enterprise Recovery Systems) and is requesting that the Marshall County Planning Commission allow him to park his concession trailers and do repairs as necessary in the existing building. He plans to build a home in the future. The property in question is Lot #12 of Poplar Pike Farms Subdivision.
