WHEREAS, on July 17, 1998, B. F. THOMPSON executed a Deed of Trust to SIDNEY F. BECK, JR., Trustee, for the benefit of WILLIAM P. KNOX, which Deed of Trust is filed for record in Real Estate Deed of Trust Book 238, Page 737-742, in the Office of the Chancery Clerk of Marshall County, Mississippi, and;

WHEREAS, default having been made in the performance of the terms and conditions of said Deed of Trust and the entire indebtedness secured thereby having been declared to be due and payable pursuant to the terms of said Deed of Trust having requested the undersigned Trustee to execute the trust and sell said land and property in accordance with the terms and provisions of the Deed of Trust for the purpose of raising the sums due thereunder, together with attorney fees, trustee fees and expenses of sale;

NOW THEREFORE, I, SIDNEY F. BECK, JR., Trustee, Will on the 11th day of July, 2005, offer for sale at public outcry and sell during legal hours, being between the hours of 11:00 A.M. and 4:00 P.M. at the main East door of the County Courthouse of Marshall County, Holly Springs, Mississippi, for cash to the highest and best bidder the following described land and property, lying and situated in Marshall County, Mississippi, and being more particularly described as follows:

PARCEL 1

A tract of land in the Southwest Quarter of the Southwest Quarter of Section 26, Township 2 South, Range 5 West, Town Of Byhalia, Marshall County, Mississippi, and being more particularly described as follows:

Commence at the Southeast corner of Section 26, Township 2 South, Range 5 West, said point being in the centerline of Mississippi Highway 309; thence West 4487.45 feet to a point; thence North 377.32 feet to a 1/2” re-bar found, said point being the point of beginning; thence South 53 degrees 46 minutes 47 seconds East 292.80 feet to a 1/2” re-bar found; thence South 9 degrees 47 minutes 03 seconds West 185.04 feet to a 1/2” re-bar set with cap on the North right of way of Vinson Road; thence North 89 degrees 56 minutes 37 seconds West 432.80 feet, along said road to a 1/2” re-bar set with cap; thence North 44 degrees 31 minutes 13 seconds East 138.19 feet to a 1/2” re-bar set with cap; thence North 27 degrees 05 minutes 13” East 288.00 feet to the point of beginning.

Said parcel 1 containing 2.184 acres, more or less, all as more particularly shown, described and depicted upon that certain plat and boundary survey prepared by Donald Jeff Hollingsworth, MLS#2525, under date of March 15, 1998, identified as Tract II thereon, direct reference to which is hereby made in aid to this description.

PARCEL 2

A tract of land in the Southwest Quarter of the Southwest Quarter of Section 26, Township 2 South, Range 5 West, Town of Byhalia, Marshall County, Mississippi, and being more particularly described as follows:

Commence at a point in the centerline of Mississippi Highway 309, said point being the Southeast corner of Section 26, Township 2 South, Range 5 West; thence West 4367.84 feet; thence North 585.29 feet to a 1/2” re-bar found on the South right of way of Mississippi Highway 78, said point being the POINT OF BEGINNING; thence South 47 degrees 40 minutes 37 seconds east 139.82 along said right of way to a 1/2” re-bar set with cap; thence South 26 degrees 06 minutes 00 seconds West 135.11 feet to a 1/2” re-bar set with a cap; thence South 33 degrees 27 minutes 48 seconds West 90.69 feet to a 1/2” re-bar set with cap; thence North 53 degrees 46 minutes 47 seconds West 140.74 feet to a 1/2” re-bar found; thence North 29 degrees 54 minutes 22 seconds East 239.91 feet to the POINT OF BEGINNING.

Said Parcel 2 containing 0.755 acre, more or less, all as more particularly shown, described and depicted upon that certain plat and boundary survey prepared by Donald Jeff Hollingsworth, MLS#2525, under date of June 1, 1998, identified as Tract I thereon, direct reference to which is hereby made in aid to this description.
