WHEREAS, on the 18th day of June, 2002, Patricia A. Brahm executed a certain Land Deed of Trust to Michael P. Lee, Trustee for the benefit of Centex Home Equity Company, LLC, which Land Deed of Trust was recorded in the office of the Chancery Clerk of Marshall County, Mississippi and recorded in Deed of Trust Book 306 at page 252 of the land records; and,

Rust College Community Development Corporation will receive sealed bids at the Rust College, 155 Rust Avenue in the City of Holly Springs, Marshall County, Mississippi, until 12:00 p.m. (Local Prevailing Time) on Monday June 27, 2005 (the “Bid Deadline”), for construction and related services in connection with the Holly Springs Martin Street Renovation (the “Work”). Rust College Community Development Corporation will publicly open and read aloud all bids at 12:05 p.m. on Monday, June 27, 2005 (the “Bid Opening”) at the Rust College.

The work consists of renovating eight existing housing units and demolishing and reconstructing three housing units along Martin Street.

The project includes

1. Contract “B” — Sites (145, 155, and 210 Martin St.): Work shall consist of demolishing the existing structure and constructing new housing units, site improvements, and landscaping per the plans and specifications.

Work shall be started immediately upon issuance of a Notice to Proceed. Prior to this, all contracts and Front End documents will have been executed and insurance in force. The completion of this work is to be done within 180 calendar days.

Attendance at the Pre-Bid Conference is highly recommended for all those submitting bids for the Work. For further information and/or directions, please contact Dr. Clencie L. Rust College Community Development Corporation reserves the right to amend specifications for the Work by Addendum issued to each person requesting a copy of the Contract Documents; to reject any and all bids for any reason at any time prior to execution of the Agreement; to waive any and all informalities in the bidding process; and to hold all bids for examination for a period not to exceed ninety (90) days.

On May 9, 2005 the Honorable Glenn Alderson, Chancellor of Marshall County Chancery Court, by order in cause number 93-235 named Chuck Thomas, Marshall County Chancery Court Clerk, as special commissioner for the court ordered sale of the following property:

268 acre tract of land located in Marshall County, Mississippi.

The Southeast part of the Southwest Quarter comprising 5 acres of Section 31, Township 1 South, Range 3 West. Also, the Northeast Corner of the Northwest Quarter of Section 6, Township 2 South, Range 3 West, containing 55 acres. 50 acres in the Northwest part of of the Northwest Quarter of Section 6, Township 2 South, Range 3 West. Also, the North (1/2) half of the Northeast Quarter, comprising 80 acres on Section 1, Township 2 South, Range 4 West. The North half of the Southwest Quarter (1/4), comprising 80 acres on Section 31, Township 1 South, Range 3 West. Containing a total of 270 acres, more or less.

The property which is the subject matter of this Complaint is located and situated in Marshall County, Mississippi, and is described as follows:

The East half of the Southeast Quarter, containing 80 acres; and 20 acres, being the East part of the West half of the Southeast Quarter, bounded as follows: commencing at the Southeast corner of the Section, and running North 160 rods; thence West 100 rods; thence South 160 rods; thence East 100 rods to the beginning. Containing in all 100 acres, and all being in Section 5, Township 3, Range 4 West; except about two acres that I have already sold off of this land, leaving about 98 acres in this tract.

ALSO:

A tract of land described as the Northeast part of the Northeast Quarter and the Northwest corner of the Northeast Quarter, 65 acres, in Section 4, Township 3, Range 4 West.

You have been made a Defendant in the Complaint filed in this Court by Bernice Rogers seeking to confirm title. Defendants other than you in this action are: Ozell Taylor, Glenn Wilkins, Linda White, Jack Nevilles aka James Taylor, Frankie Herd, Diane Malone, Carlos Malone, and Ferry Richmond.

You are required to mail or hand deliver a written response to the Complaint filed against you in this action to Jennifer L. Shackelford, Attorney for the Plaintiff, whose address is Post Office Box 130, Potts Camp, MS 38659. Your response must be mailed or hand delivered not later than thirty (30) days after the 26th day of May, 2005, which is the date of first publication of this summons. If your response is not so mailed or delivered, a judgment by default will be entered against you for the relief sought by the Plaintiff. You must also file the original of your response with the Clerk of this Court within a reasonable time afterward.
