The award, if made, will be made to the lowest qualified bidder on the basis of published quantities.

The attention of the BIDDER is directed to the State and Federal laws governing selection of and employment of labor.

MINIMUM WAGE RATES for this project have been predetermined by the Secretary of the the Department of Labor in accordance with the requirements of Federal regulations governing the expenditure of FEDERAL AID HIGHWAY FUNDS and are set out in the labor regulations contained in the proposal.

The Board of Supervisors hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

PLANS AND SPECIFICATIONS are on file in the Office of the Chancery Clerk of Marshall County, the County Engineer's office and the Office of the State Aid Engineer, 412 Woodrow Wilson Avenue, Jackson, Mississippi. This project shall be constructed in accordance with the latest edition of the Mississippi Standard Specifications for State Aid Road and Bridge Construction.

PLANS AND PROPOSALS may be secured from Larry L. Britt, County Engineer for Marshall County, Mississippi, P. O. Box 308, Oxford. The Cost is seventy-five dollars ($75.00) for plans and thirty dollars ($30.00) for the proposal, non-refundable.

Certified check or bid bond for five percent (5%) of the total bid, made payable to Marshall County and the State of Mississippi must accompany each proposal.

Northern Independent Streams Basin

Stout Creek, located in Marshall County, is on the State of Mississippi’s List of Impaired Water Bodies. Waters on this list are required to have Total Maximum Daily Loads (TMDLs) developed for each listed pollutant. A TMDL is the maximum amount of a pollutant that a stream can handle without violating water quality standards. A report has been completed detailing the determination of a TMDL for sediment for this water body.

Prior to proposing this TMDL report to the Environmental Protection Agency for approval, MDEQ is asking for public comment on the draft document. Copies of the draft TMDL may be obtained and/or inspected by contacting Debbie Pridgen at the above address and telephone number or by email (Debbie_Pridgen@ deq.state.ms.us). Persons wishing to comment upon the draft TMDL are invited to submit comments in writing to Mr. Greg Jackson at the address shown above or by email (Greg_Jackson@deq.state.ms.us) no later than 5:00 p.m. on June 2, 2005. All comments received during the public notice period will be considered prior to proposing the TMDL to the Environmental Protection Agency for approval.

ORDINANCE ADOPTING SUBDIVISION REGULATIONS FOR

CITY OF HOLLY SPRINGS, MISSISSIPPI

WHEREAS, Sections 17-1-1 through 17-1-37, of the Mississippi Code of 1972, as amended and recompiled, empower the City of Holly Springs, Mississippi, to enact subdivision regulations and provide for their administration, enforcement, and amendment; and

WHEREAS, the City of Holly Springs has prepared such regulations designed to set forth certain procedures and standards to be followed in the development of redevelopment of land subdivisions in the City of Holly Springs to assure that development of the city is orderly, healthful, efficient, and economical and has forwarded these regulations to the Mayor and Board of Aldermen with the recommendation that they be adopted; and

WHEREAS, the Mayor and Board of Aldermen of the City of Holly Springs have given due public notice of public hearing relating to such subdivision regulations, and has held such public hearing on February 1, 2005, in accordance with Section 17-1-15, Mississippi Code of 1972, as amended and recompiled; and.

WHEREAS, there has been no protest or objection expressed to the proposed subdivision regulations to be adopted.

NOW THEREFORE, BE IT RESOLVED AND ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF HOLLY SPRINGS, MISSISSIPPI:

1) That the recitals of the Preamble are true as stated.

2) The Subdivision Regulations for the City of Holly Springs heretofore adopted are repealed.

3) The Subdivision Regulations for the City of Holly Springs of 2005 shall be adopted.

4) This ordinance shall be effective thirty (30) days from its passage.

The foregoing Ordinance was introduced in writing and was then read and considered, first section by section, and then as a whole, and upon the motion of Alderman Hayes, seconded by Alderman Liddy, the question was duly put and the following votes cast to-wit:

Alderman Garrie Colhoun voted: Yes

Alderman Nancy Hutchens voted: Yes

Alderman Naylond Hayes voted: Yes

Alderman Russell Johnson voted: Yes

Alderman Tim Liddy voted: Yes

The Mayor then declared the motion passed and the ordinance adopted, during an open meeting of the Mayor and Board of Aldermen of the City of Holly Springs, Mississippi, held on this the 28th day of April, 2005.
